The Ministry of Home Affairs responds to the regime for commune-level civil servants concurrently Vice Chairman of the Veterans Association when Decree 33/2023/ND-CP expires from July 1, 2025.

Mr. Le Van Nguyen (name of the character changed) said that before July 1, 2025, he held the position of Chairman of the Commune-level Veterans Association (CCB).

After implementing the arrangement of administrative units and deploying the 2-level local government model, he was assigned to work as a civil servant of the Fatherland Front Office in the new commune.

In October 2025, when the commune organized the Veterans Association Congress, he was appointed by the Thanh Hoa Provincial Veterans Association to hold the position of Vice Chairman of the Commune Veterans Association for the term 2025-2030.

From the reality of being both a civil servant of the Office of the Fatherland Front and concurrently holding the position of Vice Chairman of the Commune Veterans Association, he requested the Ministry of Home Affairs to clarify whether he is entitled to policies according to Article 34 and Clause 2, Article 20 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government (regulations on commune-level cadres, civil servants and non-specialized personnel at commune, village, and residential group levels; effective from August 1, 2023) or not.

Regarding Mr. Long's reflection and proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Regarding policies for cadres, civil servants and non-specialized personnel at the commune level, the Ministry of Home Affairs said: For commune-level cadres and civil servants when implementing 2-level local government (from July 1, 2025) are implemented according to new regulations of the Law on Organization of Local Government No. 72/2025/QH15; Law on Cadres and Civil Servants No. 80/2025/QH15 and guiding documents for implementation.

Accordingly, the regimes and policies for commune-level cadres and civil servants specified in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government stipulating commune-level cadres and civil servants and non-specialized personnel at the commune level, in villages and residential groups have expired from July 1, 2025.

For non-specialized personnel at the commune level specified in Decree No. 33/2023/ND-CP, it is implemented according to the guidance in Official Dispatch 12/CV-BCĐ dated June 20, 2025 of the Government Steering Committee on arranging administrative units at all levels and building a 2-level local government organization model.

Based on the above regulations, your case is not subject to policies according to the provisions of Article 34 and Clause 2, Article 20 of Decree No. 33/2023/ND-CP mentioned above" - the Ministry of Home Affairs said.
