Mr. Nguyen Thanh Phong (character name has been changed) said that he is a non-specialized commune-level worker who quit his job and enjoys policies according to Decree 154/2025/ND-CP.
After that, he was assigned to a task at the hamlet with the title of Deputy hamlet head. Mr. Phong wondered whether his case would continue to enjoy the regime according to Decree 154 or whether he would have to return the received allowance.
Regarding Mr. Phong's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Clause 6, Article 3 of Decree No. 154/2025/ND-CP stipulates that the subjects of staff streamlining, if they are elected or re-recruited into agencies, organizations, and units receiving salaries from the state budget or arranging non-specialized personnel in villages and residential groups within 60 months from the date of staff streamlining, must return the allowance amount.
Accordingly, in case non-specialized workers at the commune level have quit their jobs and enjoy staff streamlining policies according to the provisions of Decree No. 154/2025/ND-CP, if they are assigned to the position of Deputy Village Head and this position is not non-specialized workers in villages or residential groups, they are not required to return the received allowance amount.
