Ministry of Home Affairs guides the application of the base salary for 9 groups of subjects

The Ministry of Home Affairs has just issued a Circular guiding the implementation of the basic salary level for 9 groups of beneficiaries of salaries and allowances in the public sector.

The Ministry of Home Affairs has just issued Circular No. 13/2026/TT-BNV guiding the implementation of the base salary level for subjects receiving salaries and allowances in public agencies, organizations, and non-business units of the Party, State, Vietnam Fatherland Front, socio-political organizations and associations. The Circular takes effect from July 1, 2026.

According to the Circular, the subjects of application include:

1. Officials and civil servants receiving salaries from the state budget working in Party and State agencies, the Vietnam Fatherland Front, socio-political organizations directly under the Vietnam Fatherland Front and social organizations performing tasks assigned by the state at the Central level; in provinces and cities directly under the Central Government; in communes, wards, special zones directly under the provincial level; in special administrative-economic units.

2. Civil servants receiving salaries from the salary fund of public non-business units according to the provisions of law.

3. Cadres, civil servants, and public employees who are sent by competent authorities to work at non-governmental associations, organizations, projects and international agencies and organizations located in Vietnam are still entitled to salaries according to the salary scale issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary regime for cadres, civil servants, public employees and armed forces amended and supplemented by Decree No. 76/2009/ND-CP, Decree No. 14/2012/ND-CP, Decree No. 17/2013/ND-CP, Decree No. 117/2016/ND-CP and Decree No. 07/2026/ND-CP.

4. Salaried people working within the staffing quota assigned by competent authorities at associations assigned tasks by the Party and State are supported by the state budget according to the provisions of Decree No. 126/2024/ND-CP dated October 8, 2024 of the Government stipulating the organization, operation and management of associations.

5. Non-specialized personnel in villages and residential groups according to the Government's Decree on the organization and operation of villages and residential groups and regimes and policies for non-specialized personnel in villages and residential groups.

6. People's Council delegates at all levels enjoy operating fees according to the provisions of current law.

7. People working in cipher organizations.

8. People doing jobs under labor contracts in administrative agencies and public non-business units specified in the Government's Decree are subject to application or agreement in labor contracts applying salary ranking according to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regimes for cadres, civil servants, public employees and armed forces.

9. The following subjects are applied to this Circular to calculate and determine the level of contribution and enjoyment of social insurance benefits and resolve regimes related to salaries according to the provisions of law:

Cadres, civil servants, public employees going to study, intern, work, treatment, and nursing (domestic and foreign) on the payroll list of Party and State agencies, socio-political organizations, public non-business units and associations supported by the state budget for operating expenses;

People who are in probation period according to the provisions of Article 24 of the Labor Code in Party agencies, State agencies, socio-political organizations, public non-business units and associations supported by the state budget for operating expenses;

Cadres, civil servants, and public employees who are being temporarily suspended from work, are being temporarily detained, or temporarily imprisoned.
