The Ministry of Home Affairs guides allowances for Vice Chairmen of Commune People's Councils who are members of the Standing Committee

The Ministry of Home Affairs guides the application of the allowance regime for cases of concurrently holding the position of Vice Chairman of the Commune People's Council and Member of the Standing Committee of the Party Committee.

Ms. Hoang Thi Huynh (name of the character changed) said that she is holding the title of Member of the Standing Committee of the Party Committee, Vice Chairman of the Commune People's Council and is entitled to a position allowance of 0.5 according to the title of Vice Chairman of the Commune People's Council.

She requested the competent authority to answer, in addition to this allowance level, is she entitled to an additional 0.5 allowance for the title of Member of the Standing Committee of the Party Committee according to the Party's guidance or not.

Regarding her questions, the Ministry of Home Affairs has responded on the Electronic Information Portal.

The Ministry of Home Affairs said that, based on point c, clause 1, Article 3 of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary regime for cadres, civil servants, public employees and armed forces, it is stipulated: If one person holds many different leadership titles, then rank the position salary or enjoy the position allowance of the leadership title as the highest.

On January 10, 2026, the Government issued Decree No. 07/2026/ND-CP on amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary regime for cadres, civil servants, public employees and armed forces amended and supplemented by Decree No. 76/2009/ND-CP, Decree No. 14/2012/ND-CP, Decree No. 17/2013/ND-CP and Decree No. 117/2016/ND-CP.

The National Assembly Standing Committee issued Resolution No. 122/2026/UBTVQH15 dated April 2, 2026 amending and supplementing a number of contents of Resolution No. 730/2004/NQ-UBTVQH11 dated September 30, 2004 on approving the salary scale for positions and position allowances for state leaders, professional and nghiệp vụ salary scales for the court and procuracy sectors.

The Central Executive Committee issued Decision No. 09-QD/TW dated March 2, 2026 on amending and supplementing a number of articles of Decision No. 128-QD/TW dated December 14, 2004 of the 9th Party Central Committee Secretariat on the salary regime for cadres, civil servants, public employees of Party agencies, the Fatherland Front and mass organizations.

Accordingly, the Ministry of Home Affairs requested her to contact the Organization Committee of the Party Committee of the agency for consideration and response according to their authority.
