Mr. Nguyen Hung (character name has been changed) requested the Ministry of Home Affairs to guide on the case of civil servants currently holding the professional title of Intermediate Cultural Propaganda Officer (code number V.10.10.36).
Accordingly, if the public employee has fully met the standards of the 3rd professional level, while the job position of the unit is approved from the 3rd to 4th professional level, there are no levels 1 and 2, and the unit has a need to use it, will the public employee be immediately appointed to the 3rd professional level or not.
Mr. Hung requested the Ministry of Home Affairs to clarify this issue according to the provisions of Article 24 of the Law on Civil Servants in 2025, Article 25 of Decree No. 259/2026/ND-CP and Decree No. 232/2026/ND-CP.
Regarding Mr. Nguyen Hung's reflection, the Ministry of Home Affairs has responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, implementing the Law on Civil Servants in 2025, the Government has issued Decree No. 259/2026/ND-CP dated June 30, 2026, regulating the recruitment, use and management of civil servants.
Article 25 of Decree No. 259/2026/ND-CP specifically stipulates the change of professional rank of civil servant positions.
In addition, Decree No. 232/2026/ND-CP dated June 26, 2026 of the Government stipulates the position of civil servants. Article 14 of the Decree stipulates the authority and responsibilities of ministries, provincial-level People's Committees and other civil servant management agencies; Article 15 stipulates the authority and responsibilities of public non-business units.
The Ministry of Home Affairs requests that in unclear cases, Mr. Nguyen Hung contact the competent agencies and units specified in Article 58, Article 59 and Article 60 of Decree No. 259/2026/ND-CP and Article 14, Article 15 of Decree No. 232/2026/ND-CP for consideration, guidance and settlement according to their authority.
