Ministry of Home Affairs clarifies 50% ratio when ranking as Deputy Head of the People's Council

The Ministry of Home Affairs guides the determination of the number and rank for Deputy Heads of People's Councils at provincial and commune levels.

The Ministry of Home Affairs has just issued a document responding to the Department of Home Affairs of Dien Bien province regarding the ranking of civil servant ranks according to job positions, as stipulated in Decree 361/2025/ND-CP of the Government.

In which, the Ministry provides specific guidance on the ratio of 50% for senior specialist ranks and main specialist ranks for Deputy Heads of People's Councils at provincial and commune levels.

According to the provisions of point b, clause 1, Article 3 of Decree No. 204/2004/ND-CP, cadres holding positions elected under the professional and professional salary classification and enjoying leadership position allowances are classified according to the rank and grade of administrative civil servants and enjoying leadership position allowances of the current elected position.

Regulation No. 368-QD/TW has stipulated the list of positions, groups of positions, leadership positions of the political system and the meeting of the Standing Committee of the Provincial Party Committee and City Party Committee to review, promptly adjust, and supplement positions and positions according to management decentralization; amend and complete the system of relevant documents, ensuring compliance with the regulations of the Central Government.

Therefore, based on equivalent titles and positions according to the regulations of competent authorities, the Ministry of Home Affairs requests the Department of Home Affairs of Dien Bien province to base on Decree No. 204/2004/ND-CP and point b, clause 1, point b, clause 2, Article 8, clause 3, Article 9 of Decree No. 361/2025/ND-CP (including the percentage of civil servants arranged according to job positions) to advise competent authorities to specifically determine the number of cadres and implement corresponding ranks for the positions of Deputy Head of the Provincial People's Council and Deputy Head of the Commune People's Council according to cadre management decentralization.
