At the 10th Session, the 15th National Assembly passed the Law on Public Employees (amended). The Law takes effect from July 1, 2026.
The 2025 Law on Public Employees has shown innovative thinking, creating a synchronous legal corridor for public employee management in a dynamic, transparent, and effective direction, improving the quality of operations of public non-business units associated with the requirements of innovation and digital transformation in the new period.
One of the new contents of the 2025 Law on Public Employees, according to Deputy Minister of Home Affairs Truong Hai Long, is the innovation of mechanisms and methods of recruitment, use and management of public employees according to job positions, taking job positions as the main basis for implementing recruitment, arrangement, evaluation, planning, appointment, training, fostering and implementing regimes and policies for public employees.
The Deputy Minister of Home Affairs said that the Law stipulates that recruitment is carried out in 2 forms: competitive examination and admission consideration; supplementing regulations on admission for people with work experience in both the public and private sectors to become civil servants.
Determining job positions at public non-business units includes 3 groups: Management job positions; Professional and nghiep vu job positions; Support job positions.

The position of public employee is specified in Article 23 of the Law on Public Employees. In which, based on determining the position of public employee, including: Functions, tasks and organizational structure of public service units; Level of complexity, nature, characteristics, scale of operation of public service units; scope, objects of service; professional and nghiep vu management process; Professional and nghiep vu of industry, field of professional activities and professional and nghiep vu of other industry and field as prescribed; Level of modernization of means, equipment, equipment, working conditions and application of science, technology, digital transformation.
The job position of civil servants includes the following main contents: Name of job position; Job description and competency framework of the job position.
Regarding job position classification, including: Management job position; Professional and nghiep vu job position; Supporting job position.
Article 24 of the Law stipulates changes in job positions. Accordingly, public employees are transferred to new job positions if they meet the standards and conditions of that job position and the unit still needs a job position.
Job position changes are decided by competent authorities, ensuring publicity, transparency, objectivity and compliance with the law.
