On the morning of May 7, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Employment (amended).
Delegate Nguyen Hoang Bao Tran (Binh Duong Delegation) said that according to the draft, employees who are eligible for pensions are not subject to unemployment insurance. Therefore, this subject is not eligible for unemployment insurance.
In reality, many cases of employees who have met the conditions for social insurance payment period to receive pension according to regulations, but have not reached retirement age, but due to objective reasons such as illness, disease, they still do not receive unemployment insurance.
The delegate said that in these cases, it is necessary to consider giving workers unemployment insurance with the prescribed duration to help workers have medical expenses while waiting to receive pensions.
The delegate also mentioned the responsibility to notify about the search for jobs for workers. Accordingly, during the period of unemployment benefits, employees must notify monthly about finding a job for a public employment service organization where they are receiving unemployment benefits.
The delegate said that this regulation does not accurately reflect the current labor market reality. Workers can find jobs through many different channels such as social networks, online recruitment floors, or personal relationships without having to go through a public employment service center.
Requiring them to report periodically takes time and travel costs, especially for people in remote areas or temporarily residing elsewhere after losing their jobs.
Monthly reporting increases the administrative burden, causing employees to be hesitant when enjoying legitimate benefits.
The delegate said that workers should be allowed to notify about finding a job through online public service portals, emails, mobile applications or electronic identification accounts.
At the same time, it is recommended to encourage data connection between reputable recruitment floors and insurance agencies to automatically update the job search process.
Regarding the subjects participating in unemployment insurance, the delegate said that in the coming time, researching and considering removing the regulation on "life institutions" will lead to a situation where many cadres, civil servants, public employees, and workers are likely to lose their jobs if they do not complete their assigned tasks.
To ensure that the unemployment insurance policy is expanded to cover many subjects, fair in access to social security, and at the same time encourage cadres to strive to fulfill their tasks and be aware of keeping their jobs, the delegate suggested considering adding the subjects eligible to participate in unemployment insurance as " cadres, civil servants, public employees, and workers".
The female delegate believes that this will be a proactive step for the state in protecting public sector workers in new conditions.
Delegate Tran Van Khai - Vice Chairman of the Committee for Science, Technology and Environment - said that the draft has not mentioned an effective inter-sectoral coordination mechanism in implementing employment policies. Lack of synchronous coordination can easily lead to overlap or lack of responsibility, reducing the effectiveness of implementation.
From there, the delegate proposed to perfect and supplement the clarification of the inter-sectoral coordination mechanism in implementing employment policies to determine responsibilities from the central to local levels; at the same time, develop a roadmap to deploy a national database on workers, ensuring synchronous and effective digital transformation.
