Mr. Nguyen Van Minh (character's name has been changed) questioned the funding source for giving bonuses to organizations and individuals outside the payroll (outside ministries and branches).
Mr. Minh gave an example, the Ministry of Science and Technology awarded the Commemorative Medal to a local individual who is a leader of the Department of Agriculture and Rural Development. When awarding Commemorative Medals, ministries and branches do not pay bonuses because they think they are not on the payroll of ministries, branches and local exchanges.
"So is the locality paying correctly in this case? Is the paying agency the Provincial People's Committee or the Director of the Department of Agriculture and Rural Development?" - Mr. Minh reflected.
When the Department Director grants certificates of merit to collectives and individuals outside the industry, it is similar to the above, and cannot be paid because it is only paid to collectives and individuals under the salary fund payroll.
"Is the above case understood according to Clause 4, Article 11 of the Law on Emulation and Commendation and Clause 2, Article 51 of Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government accurate?" - Mr. Minh wondered and expressed his hope that the Ministry of Home Affairs and the Central Emulation and Reward Committee would give specific answers. From there, so that collectives and individuals can be commended and receive timely rewards.
Regarding the reflection and recommendation of Mr. Nguyen Van Minh, the Ministry of Home Affairs has responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, Article 11 of the Law on Emulation and Commendation stipulates:
The Emulation and Reward Fund is formed on the basis of the state budget, from the emulation and reward fund of enterprises, other economic organizations, contributions from domestic individuals, organizations, individuals, foreign organizations and other sources of revenue according to the provisions of law.
The Emulation and Commendation Fund is used to spend on organizing emulation and commendation work; spend on emulation titles and forms of commendation for achievements in building and defending the Fatherland; spend on printing, making commendation items or souvenirs for individuals, collectives, and households.
Ministries, departments, branches, localities, agencies, organizations and units establish emulation and reward funds to spend on organizing emulation movements and implementing policies and regimes on rewards in accordance with the provisions of law.
The person who decides on the reward is responsible for paying the reward from the emulation and reward fund managed by his/her level; in case the President, the Government, and the Prime Minister decide on the reward, the agency that has proposed the reward as prescribed in Clauses 2, 3, and 4, Article 83 of this Law is responsible for paying the reward from the emulation and reward fund managed by his/her level.
The Government stipulates in detail the establishment, management and use of emulation and reward funds.
Accordingly, the person making the reward decision is responsible for paying the reward from the emulation and reward fund managed by his/her agency.
