The Ministry of Home Affairs talks about salary guidance in state-owned enterprises

The Ministry of Home Affairs has drafted a Circular guiding the implementation of labor management, wages, remuneration, and bonuses in State-owned enterprises.

Mr. Ha Van Ngoc (character's name has been changed) learned that the Government issued Decree No. 44/2025/ND-CP dated February 28, 2025.

Accordingly, the basic salary level for members of the Board of Members and Auditors has been stipulated. As for the Executive Board and employees, there are no specific regulations.

Therefore, the basis for building the scale and salary table of the Executive Board and employees is not clear. "I hope the Ministry of Home Affairs will pay attention to guiding" - Mr. Ngoc suggested.

Regarding Mr. Ngoc's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Accordingly, implementing Decree No. 44/2025/ND-CP dated February 28, 2025 of the Government regulating labor management, wages, remunerations, and bonuses in state-owned enterprises, the Ministry of Home Affairs has drafted a Circular guiding the implementation of labor management, wages, remunerations, and bonuses in state-owned enterprises.

According to the draft, enterprises develop labor plans, recruit and employ labor and implement regimes and policies for employees according to the provisions of Article 5 of Decree No. 44/2025/ND-CP.

The development and promulgation of salary scales, salary tables, and salary allowances are carried out in accordance with the provisions of Article 6 of Decree No. 44/2025/ND-CP, in which for enterprises that have developed salary scales and salary tables for employees, the Executive Board, Member Councils, and Controllers ensure the provisions of Clause 2, Article 6 of Decree No. 44/2025/ND-CP, and are entitled to continue implementing according to the current salary scale and salary table of the enterprise.

In case the salary scale, salary table, and salary allowances do not comply with the provisions of Clause 2, Article 6 of Decree No. 44/2025/ND-CP, the enterprise must amend, supplement or issue a new salary scale, salary table.

Regarding the salary of the employee and the Executive Board, in the draft, the Ministry of Home Affairs proposes to determine the salary fund through the average salary; Determine the salary fund through a stable salary unit price and identify the salary fund for some cases, advance, prevent and distribute salaries.

According to the Ministry of Home Affairs, the draft Circular is being sent for comments to ministries, branches, localities, and enterprises and is currently being urgently compiled and finalized for promulgation.
