Reflecting to the Ministry of Home Affairs, Mr. Nguyen Van Binh (character name has been changed) said that Bac Ninh Provincial People's Committee has issued Decision No. 36/2026/QD-UBND dated May 22, 2026, decentralizing to the Chairman of the Commune-level People's Committee to perform a number of tasks related to salaries and management of civil servants and public employees under its authority.
Accordingly, the Chairman of the Commune-level People's Committee is allowed to carry out regular salary promotions, salary promotions ahead of schedule; to enjoy and increase seniority allowances beyond the frame, professional seniority allowances, professional preferential allowances and other types of allowances according to regulations. The Chairman of the Commune-level People's Committee is also allowed to decide to appoint professional titles for public employees after probationary periods and implement a number of other contents on public employee management.
From this decentralization, Mr. Binh wonders whether the Chairman of the Commune-level People's Committee can continue to authorize the heads of specialized agencies under the Commune-level People's Committee and the heads of public non-business units to sign decisions related to civil servants and public employees under the management scope of each unit or not.
The contents mentioned include: Decisions on regular salary grade promotion, salary grade promotion ahead of schedule; allowing and increasing seniority allowances beyond the frame, professional seniority allowances and other types of allowances according to regulations for civil servants and public employees under management authority, except for positions appointed by the Chairman of the Ward People's Committee.
Mr. Binh also requested the Ministry of Home Affairs to clarify, if this authorization is carried out, what regulations and clauses of the law are based on.
Regarding Mr. Binh's reflection and proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Regarding the implementation of tasks related to early salary increases and regular salary increases specified in Article 4 of Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs guiding the implementation of the regime of regular salary increases and early salary increases for cadres, civil servants, public employees and laborers.
Therefore, the Ministry of Home Affairs requests him to study the above regulations. At the same time, the organization of policy implementation for cadres, civil servants, and public employees in Bac Ninh province is under the authority of the Chairman of the Provincial People's Committee.
