Accordingly, Article 23 of the draft Law clearly states the duties and powers of the Chairman of the People's Committee at the commune level, including:
1. Lead and manage the work of the People's Committee; convene and chair meetings of the People's Committee.
2. Lead and direct the implementation of tasks of implementing the Constitution, laws, documents of superior state agencies and People's Councils, People's Committees at their level; inspect and handle violations in the process of implementing the Constitution and laws in the area.
3. Lead and be responsible for the operation of the state administrative apparatus, ensuring the unity and smoothness of the administrative system; for implementing administrative reform, reforming public services and civil servants in state administrative agencies in the area;
Effectively apply technology, information, digital transformation in the operations of local authorities at their level, in handling administrative procedures and providing public services in the area according to the provisions of law.
4. Lead, direct, urge, and inspect the work of other specialized agencies and administrative organizations under the People's Committees at their level.
5. Direct and be responsible for organizing the implementation of local budget estimates; effectively manage and use investment capital, finance, budget sources, public assets, infrastructure assigned in the area according to the provisions of law and decentralization of the provincial People's Committee.
6. Direct and organize the implementation of socio-economic development tasks, develop sectors and fields, develop private economy, develop science and technology, innovation and digital transformation in the area;
Organize the implementation of local state management in the fields of economy, land, agriculture, rural areas, resources, environment, trade, services, industry, construction, transportation, transportation, education, health, judicial administration, judicial equivalent, internal affairs, labor, information, culture, society, tourism, physical education and sports in the area according to the provisions of law.
7. Direct and organize the implementation of tasks on foreign affairs activities and international cooperation, ensuring national defense, security, order and social safety in the area according to the provisions of law; the implementation of tasks on asset protection of agencies and organizations;
Ensure human rights, civil rights; prevent and combat crimes and other violations of the law in the area according to the provisions of law.
8. Direct and organize the implementation of policies on ethnicity and religion; preserve and promote the cultural identity of ethnic minorities and religious followers in the area according to the provisions of law.
9. Responsible for organizing the implementation of plans approved by competent authorities in the area; managing markets, shopping malls, tourist attractions, preschools, primary schools, secondary schools, medical facilities, and social welfare facilities under their authority;
Maintain local cultural traditions, manage cultural, sports and entertainment establishments in the area according to the provisions of law.
10. Direct and be responsible for the recruitment, use and management of civil servants and public employees in the area according to the provisions of law and the decentralization of the superior state agency;
Decision to appoint, dismiss, transfer, and remove from the positions of head and deputy head of other professional agencies, administrative organizations, and public service units under the People's Committee at their level;
The decision to temporarily suspend the work of the Vice Chairman of the People's Committee at his/her level, the head of another professional agency, administrative organization, or public service unit under the People's Committee at his/her level.
11. Direct and promptly handle emergency situations related to natural disasters, epidemics, and disasters in the area.
12. Responsible for providing essential public services in the area on lighting, water supply, wastewater treatment, environmental sanitation, fire prevention and fighting according to the provisions of law.
13. Implement the work of receiving citizens, handling complaints and denunciations, preventing and combating corruption, negativity and waste in the activities of local authorities at their level and in socio-economic activities in the area according to the provisions of law.
14. Guiding and inspecting the activities of self-management of villages in the area according to the provisions of law.
15. Issue decisions and other administrative documents on issues under its tasks and powers; abolish, amend, supplement, and replace documents issued by itself when considered no longer appropriate or illegal.
16. To represent the People's Committee in deciding on issues under the authority of the People's Committee, except for the contents specified in Clause 2, Article 40 and report to the People's Committee at the most recent meeting.
17. Perform the assigned tasks and powers, delegated authority and other tasks and powers according to the provisions of law.
The draft Law on Organization of Local Government (amended) is expected to be considered and approved by the National Assembly at the 9th Session, effective from July 1, 2025.
