Ms. Nguyen Thi Phuong (character's name has been changed) said that she is a civil servant and was awarded the title of "Excellent Doctor" by the President - a noble award recognizing her contributions to the medical industry.
Recently, when reading Decree No. 116/2024 (amending and supplementing Decree 138/2020/ND-CP), she was interested in the regulations on the conditions for considering promotion from specialist to senior specialist.
According to her, Clause 20, Article 1 of this Decree clearly states 3 cases that are considered for promotion without having to take an exam, if civil servants have one of the following achievements: Awarded the Third Class Labor Medal or higher; Awarded a Certificate of Merit from the Prime Minister; Awarded the title of Emulation Fighter at the ministerial, sectoral, or provincial level or higher (with conditions for assessment of good completion of tasks).
However, the regulation does not mention the title of "Excellent Doctor".
"I am the person awarded the title of Excellent Doctor by the President, so can this achievement be used to consider raising the rank from specialist to senior specialist according to Decree 116/2024?" - Ms. Phuong asked.
Regarding Ms. Phuong's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.
The Ministry of Home Affairs said that the achievements used as the basis for considering promotion from specialist to senior specialist are stipulated in Clause 2, Article 31a of Decree 138/2020 (amended and supplemented in Decree 116/2024).
For promotion from the rank of employee or equivalent to the rank of officer or equivalent; from the rank of officer or equivalent to the rank of specialist or equivalent: Awarded a Certificate of Merit by the Prime Minister and twice achieved the title of Emulation Fighter at the grassroots level;
For promotion from the rank of specialist or equivalent to the rank of senior specialist or equivalent: Awarded the Third Class Labor Medal and achieving the title of Emulation Fighter at the level of ministry, department, branch, province, central organization;
For promotion from the rank of senior specialist or equivalent to the rank of senior specialist or equivalent: Awarded the First Class Labor Medal or achieving the title of National Emulation Fighter.
The Ministry of Home Affairs recommends that she discuss with the civil servant management agency where she works for resolution.
