Mr. Dinh Van Viet (character's name has been changed) was born in 1967, currently working at the provincial Department of Education and Training as a specialist.
According to Decree No. 178/2024 and Clause 3, Article 3 of Decree No. 158/2018, Mr. Viet found that his case is subject to the preferential early retirement policy.
On February 20, 2025, he submitted a voluntary application for early retirement (retirement proposal date: From March 1, 2025) to the Department of Organization and Personnel, Department of Education and Training of the province.
However, through discussion, the Department of Organization and Personnel said that his case was not included in the list of considerations for early retirement in March 2025 because he was currently seeking the opinion of the Ministry of Home Affairs.
"In my case, am I eligible for the early retirement policy according to the provisions of Decree 178/2024/ND-CP? If I want a petition to be reviewed on my case, which agency should I send a petition to, and in what procedures?" - Mr. Viet asked.
Regarding Mr. Viet's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Accordingly, the Ministry of Home Affairs issued Document No. 1814 dated April 26, 2025, Document No. 2034 dated May 5, 2025 guiding the implementation of Decree No. 178/2024 dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system (amended and supplemented in Decree No. 67/2025).
In particular, the Ministry has requested ministries, branches and localities to be responsible for responding, answering and guiding the content of policies and regimes for cadres, civil servants, public employees and workers under their management in the arrangement of the apparatus and administrative units at all levels;
At the same time, promptly respond to people's petitions sent on the Electronic Information Portal of ministries, branches, localities and their agencies related to policies and regimes according to Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).
Accordingly, the Ministry of Home Affairs recommends that you contact the local authorities where you work for answers and answers according to regulations.
According to Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025), people with an age of 2 years to 5 years are eligible for retirement as prescribed in Appendix I of Decree 135/2020 and have paid enough compulsory social insurance and are entitled to the following policies:
No deduction of pension rate due to early retirement;
Receive a subsidy of 5 months of current salary for each year of early retirement compared to the retirement age prescribed in Appendix I issued with Decree No. 135/2020;
Receive a subsidy of 5 months of current salary for the first 20 years of work with compulsory social insurance contributions. From the 21st year onwards, for each year of work with compulsory social insurance contributions, a subsidy of 0.5 months of current salary will be granted.
In case of full 15 years of work, there is a compulsory social insurance and subject to the subject of pension in accordance with the law on social insurance at the time of retirement before the age of 4 -month salary is now entitled to the first 15 years of work; From the 16th year onwards, each year the work has compulsory social insurance is allowed to be allowed to grant 0.5 months of the current salary.
