Mr. Dinh Kieu Hung (Son La) learned that according to the provisions of Point a, Clause 2, Article 7 of Decree No. 43/2023/ND-CP dated June 30, 2023 of the Government, the consideration of upgrading the Inspector to Senior Inspector, in addition to meeting other conditions, only requires 1 of 2 conditions: Having a Third-class Labor Medal or higher or achieving the title of Emulation Fighter at the ministerial, branch, or provincial level.
However, according to the provisions of Point b, Clause 2, Article 31 of Decree No. 138/2020/ND-CP dated November 27, 2020 of the Government, the consideration of promotion from specialist to senior specialist, in addition to meeting other conditions, the requirement for excellent achievements must meet both conditions: Having a Third-class Labor Medal and achieving the title of Emulation Fighter at the ministerial, sectoral and provincial levels.
From the above regulations, Mr. Hung wondered: "For Inspectors working in the Inspection sector, what regulations apply regarding the requirement for excellent achievements in public service? What regulations will be applied to the procedure for promotion from Inspector to Senior Inspector?"
Regarding the reflection and recommendation of Mr. Dinh Kieu Hung, the Ministry of Home Affairs said: On September 17, 2024, the Government issued Decree No. 116/2024/ND-CP. Accordingly, the regulations on considering promotion of civil servants when there are achievements in public service activities are stipulated in Clause 20, Article 1 of Decree No. 116/2024/ND-CP as follows:
Consider upgrading from specialist or equivalent to senior specialist or equivalent if one of the following conditions is met:
Awarded the Third Class Labor Medal or higher and evaluated and classified as having completed tasks well or better in the working year immediately preceding the year of promotion consideration;
Awarded a Certificate of Merit by the Prime Minister and having 3 consecutive years of work prior to the year of promotion, being assessed and classified as having completed tasks well or better;
Awarded the title of Emulation Fighter of a Ministry, Department, Branch, Province or higher and having 3 consecutive years of work before the year of promotion, being assessed and classified as having completed tasks well or better, of which at least 1 year was assessed and classified as having completed tasks excellently.
