Ms. Ha Thi Trinh (character's name has been changed), an officer in the police force, has sent a petition requesting to keep the allowances and salary unchanged for 6 months after the administrative unit merger.
She cited Resolution No. 76/2025/NQ-UBTVQH15 dated April 15, 2025 of the National Assembly Standing Committee, which stipulates that cadres, civil servants and public employees are allowed to retain their salaries and allowances for 6 months from the date of the decision to arrange new work after the merger.
However, according to Ms. Trinh, there are currently no specific instructions for police officers and soldiers to apply this regulation.
Therefore, she recommended that the Ministry of Public Security and the Ministry of Home Affairs soon issue a document guiding to ensure the rights of police officers after the merger and expressed her hope that the agencies would soon consider and respond.
Regarding Ms. Trinh's reflection on her petition, the Ministry of Home Affairs responded on the Electronic Information Portal.
On August 9, 2025, the Steering Committee for the arrangement of administrative units at all levels and the development of a model for the organization of local government at both levels issued Document No. 16/CV-BCD on the implementation of allowance regimes for cadres, civil servants, public employees and workers after the arrangement of administrative units and local government organizations at both levels, including allowances for national defense and security (Folding 1).
Accordingly, based on current legal provisions in Resolution No. 730 2004 of the National Assembly Standing Committee, Decision No. 128 of the Central Party Secretariat, Decree No. 204 2004 of the Government and documents amending, supplementing and guiding the implementation, current salary allowance regimes include: leadership position allowance; seniority allowance beyond the framework; concurrent allowance; regional allowance; attraction allowance; mobile allowance; toxic and dangerous allowance; job responsibility allowance; national defense and security service allowance; seniority allowance; job responsibility allowance; job preferential allowance; special allowance applied to the armed forces; annual allowance for work in areas with special socio-economic conditions; special socio-political allowance; party allowance; socio-political allowance; socio-political allowance; socio-political allowance; socio-political allowance for national defense and security services; seniority allowance; job responsibility allowance; job allowance; job preferential allowance according to the profession.
The maintenance (reservation or continued enjoyment) of allowances according to the orientation at Point 3.1, Clause 3, Official Dispatch No. 03 and Point 4.2, Clause 4, Section B of Official Dispatch No. 11/CV-BCD is implemented for cadres, civil servants, public employees, and workers receiving salaries from the state budget affected by the arrangement of administrative units who are still cadres, civil servants, public employees, and workers at agencies and organizations in the political system.
Accordingly, before being arranged, cadres, civil servants, public employees, and workers who are receiving any allowance from the above salary allowances will continue to receive that allowance after the arrangement.
In case cadres, civil servants, public employees, and workers have less than 6 months remaining working time from the date of the decision on arrangement (due to retirement at the right age, early retirement, severance pay, etc.), they will continue to receive allowances until the remaining working time is over.
The Ministry of Home Affairs has asked her to contact the Department of Home Affairs of Cao Bang province for specific instructions according to regulations.
