The principles for establishing and managing administrative unit boundary records are clearly stated in Circular No. 11/2024/TT-BNV of the Ministry of Home Affairs.

Minister of Home Affairs Pham Thi Thanh Tra has signed and issued Circular No. 11/2024/TT-BNV regulating the establishment and management of administrative boundary records.

This Circular provides for the establishment and management of boundary records of administrative units of provinces and centrally run cities (provincial level); districts, towns, provincial cities, and centrally run cities (district level); communes, wards, and towns (commune level).

Regarding the principles of establishing and managing administrative unit boundary records, the Circular clearly states:

Administrative unit boundary records are established when the Resolution of the National Assembly, the Standing Committee of the National Assembly on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries; the decision of the competent authority on determining administrative unit boundaries in areas where administrative unit boundaries have not been unified comes into effect or when it is necessary to move the location of administrative unit boundary markers in the field.

Including the establishment of new administrative unit boundary records when administrative units are established, merged, or divided according to the decision of competent authorities. The correction and supplementation of administrative unit boundary records for administrative units not falling under the cases specified in Point a, Clause 1 of this Article shall be carried out.

The establishment of administrative unit boundary records shall comply with the provisions of this Circular and the provisions of law on techniques for determining administrative unit boundary lines, placing administrative unit boundary markers, and establishing administrative unit boundary records at all levels.

The management and storage of administrative unit boundary records shall comply with the provisions of this Circular and the provisions of law on archiving.

The Circular also clearly states the procedures for preparing administrative unit boundary records; Appraising and accepting administrative unit boundary records.

The Ministry of Home Affairs said that in recent times, the boundaries of administrative units at all levels in provinces and centrally run cities have changed and fluctuated due to the need to establish, dissolve, merge, divide, and adjust the boundaries of administrative units at all levels to meet the needs of socio-economic development, the urbanization process, and ensure compliance with the plans approved by competent authorities.

After the competent authority decides to establish, dissolve, merge, divide, or adjust the boundaries of administrative units at all levels, it is necessary to carry out the work of establishing (including establishing new, adjusting, and supplementing) the records of administrative unit boundaries at all levels accordingly.

The process of socio-economic development, natural geological movements, floods, etc. lead to changes and deformations in the boundaries between administrative units.

The above-mentioned practical problems lead to difficulties in the administrative management of the territory of local authorities at all levels. There are situations where land belongs to one administrative unit but people living and cultivating on that land belong to the boundaries of another administrative unit,... it is necessary to re-determine.
