Mr. Thai Hoang Giang (Tra Cu district, Tra Vinh province) wondered if the Chairman of the District People's Committee awarded the title "Advanced Laborer" and "Emulation Fighter at the grassroots level" to cadres, civil servants, and public employees working in the district's departments, branches, and sectors and awarded the title "Emulation Fighter at the grassroots level" to cadres, civil servants, and non-professional workers in communes and towns. Was the reward fund used from the regular activities of the agency, unit, or the People's Committee of the commune or town where the reward recipient is located or from the reward fund of the District Emulation and Reward Board?
Regarding Mr. Thai Hoang Giang's question, the Ministry of Home Affairs said: Clause 2, Article 65 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of a number of articles of the Law on Emulation and Commendation stipulates:
The emulation and reward funds at the provincial, district and communal levels are formed from the annual state budget in the total regular budget expenditure for each budget level of the provinces and cities and are allocated from the beginning of the year according to the ratio.
In which, the emulation and reward fund of provincial departments, branches and sectors is formed from the annual state budget with a maximum level of 20% of the total salary fund according to the rank and grade of cadres, civil servants and public employees in the payroll and approved wages for the whole year and from contributions of individuals and organizations at home and abroad;
The emulation and reward fund at the provincial, district and communal levels is formed from the annual state budget with a maximum level of 1.0% of regular budget expenditure for each budget level in the plain provinces and cities and a maximum level of 1.5% of regular budget expenditure for each budget level in the mountainous, midland, Central Highlands, remote and isolated provinces and from contributions from domestic and foreign individuals and organizations.
Clause 2, Article 67 of Decree No. 91/2017/ND-CP dated July 31, 2017 stipulates: Heads of agencies at all levels are responsible for paying bonuses to collectives and individuals on the payroll and salary fund managed by their level and accounting for expenses according to regulations.
Therefore, the reward fund for cadres, civil servants, and public employees working in district departments, offices, and branches who have achieved the title of "Advanced Laborer" or "Emulation Fighter at the grassroots level" will be taken from the district-level emulation and reward fund; the reward fund for cadres, civil servants, and non-professional workers in communes and towns who have achieved the title of "Emulation Fighter at the grassroots level" will be taken from the commune-level emulation and reward fund.
