Mr. Phan Quang Dung holds the professional title of lecturer (V.07.01.03), has a doctorate degree, and is currently working at a public university.
Mr. Dung is about to reach retirement age according to regulations, however, he is still healthy and wishes to continue working for the unit.
Mr. Dung learned that according to Clause 4, Article 56, Law on Higher Education: Lecturers with doctoral degrees, lecturers with the title of professor, associate professor working in higher education institutions can extend their working time from retirement age to teach and do scientific research, if they are healthy enough, voluntarily extend their working time, and the higher education institution has a need.
According to Article 2 of Decree No. 50/2022/ND-CP dated August 2, 2022 of the Government, the subjects of application for extended working hours only apply to:
(1) Officials with the academic titles of professor and associate professor.
(2) Officials holding professional titles that require doctoral training standards.
"So, if the university has a need, can I extend my working time at the professional title of lecturer (V.07.01.03) when I reach retirement age according to the provisions of the Law on Higher Education?" - Mr. Dung wondered.
Regarding the reflection and recommendation of Mr. Phan Quang Dung, the Ministry of Home Affairs has responded.
According to the provisions of Clause 2, Article 2 of Decree No. 50/2022/ND-CP dated August 2, 2022 of the Government regulating retirement at an older age for civil servants in public service units, the subjects whose working time is extended include "civil servants holding professional titles that require training standards of doctorate or specialist II".
The Ministry of Home Affairs said that Mr. Dung is subject to the regulations on retirement at an older age in Decree No. 50/2022/ND-CP.
