The Ministry of Justice announced the appraisal dossier of the draft Law amending and supplementing 9 laws on military and national defense at: National Defense Law; Law on Officers of the Vietnam People's Army; Law on Professional Military Personnel, Workers and National Defense Public Employees; Law on Military Service; Vietnam Border Guard Law; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Militia and Self-Defense Forces.
In the draft law dossier, the Ministry of National Defense proposed to amend and supplement a number of articles of the Law on Military Service.
Notably, the Ministry proposes to amend and supplement Clauses 2, 3 and 4 of Article 44 of this law.
Accordingly, unit commanders from the regiment level and equivalent and above decide to discharge each subordinate officer and soldier under their authority; organize a ceremony to send off subordinates and soldiers who have completed their service in the army and hand them over to the Provincial Military Command that has assigned troops.
The discharge time must be notified 30 days in advance to the non-commissioned officers, soldiers and the Provincial Military Command where the troops are assigned or the agency or organization where they work and study before enlisting.
Provincial People's Committees, commune-level People's Committees, Provincial Military Commands and agencies and organizations must organize the reception of demobilized non-commissioned officers and soldiers.
Explaining the above proposal, the Ministry of National Defense said that the current draft identifies the Provincial Military Command as the unit organizing the handover of non-commissioned officers and soldiers to receiving units, and at the same time is responsible for receiving non-commissioned officers and soldiers who have completed their military service of the units (implementing the principle of receiving from which unit, then handing it over to that unit).
Specific implementation will be stipulated in the circulars of the Minister of National Defense (including Circular No. 148/2018/TT-BQP dated October 4, 2018 regulating the selection and conscription of citizens, amended and supplemented by Circular No. 68/2025/TT-BQP dated July 3, 2025; Circular No. 279/2017/TT-BQP dated October 31, 2017 regulating the demobilization of non-commissioned officers and soldiers serving in the People's Army, amended and supplemented by Circular No. 65/2025/TT-BQP dated July 3, 2025).
