The Ministry of Justice announced the appraisal dossier of the draft Law amending and supplementing 9 laws on military and national defense at: National Defense Law; Law on Officers of the Vietnam People's Army (VPA); Law on Professional Military Personnel, Workers and National Defense Public Employees; Law on Military Service; Vietnam Border Guard Law; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Militia and Self-Defense Forces.
Notably, in the draft law dossier, the Ministry of National Defense proposed to amend and supplement a number of articles of the Law on Officers of the Vietnam People's Army.
In which, it is proposed to amend and supplement points g, h, i, k, n, o Clause 1 (basic position of officers) Article 11 of the Law on Officers of the Vietnam People's Army as follows:
Commander, Political Commissar: Navy Region, Navy Region; Commander, Political Commissar of Provincial Military Command;
Deputy Commander, Deputy Political Commissar: Navy Region; Deputy Commander, Deputy Political Commissar of the Provincial Military Command;
Division Commander, Political Commissar of the Division;
Deputy Division Commander, Deputy Political Commissar of the Division; Brigade Commander, Political Commissar of the Brigade;
Battalion Commander, Political Commissar of the Battalion, Commander of the Military Command of the commune level;
Deputy Battalion Commander, Deputy Political Commissar of the Battalion; Deputy Commander, Deputy Political Commissar of the Military Command of commune level.
Explaining this arrangement, the Ministry of National Defense said that the whole country has dissolved 694 district-level military commands, established about 140 regional defense commands directly under the provincial-level military command (each province organizes from 3 to 6 regional defense commands according to the requirements and tasks of each area).
The whole country also dissolved 44 Provincial Border Guard Commands, established 30 Border Guard Commands directly under the Provincial Military Command, units equivalent to the division level, and maintained the ceiling rank.
In the Government's Decree stipulating positions and equivalent titles; positions and titles with the highest military rank being Lieutenant General, Deputy Admiral of the Navy, Major General, Rear Admiral of the Navy of Vietnam People's Army officers, the position and title of Commander of the Provincial and City Military Command and equivalent with the highest military rank being Major General, equivalent to Commander, Political Commissar of the Vietnam Coast Guard Region (excluding Hanoi and Ho Chi Minh City).
According to the resolutions of the Central Military Commission and the Government on the organization and operation of the Military Command of communes, wards, and special zones, the Commander of the Military Command of commune level is equivalent to the Battalion Commander, the military rank ceiling is Lieutenant Colonel, the Deputy Commander of the Military Command of commune level is equivalent to the Deputy Battalion Commander, the military rank ceiling is Major.
Therefore, the addition as in the draft aims to fully regulate the positions and titles equivalent of officers in the Army.
