The Central Inspection Commission has just issued Instruction No. 15-HD/UBKTTW (Instruction 15) on amending and supplementing Instruction No. 05-HD/UBKTTW dated November 22, 2022 of the Central Inspection Commission on implementing a number of articles in Regulation No. 69-QD/TW dated July 6, 2022 of the Politburo on disciplining Party organizations and Party members who violate.
Accordingly, Instruction 15 removes points 8.1, 8.2, Clause 8, Section III of Instruction 05.
Clause 8, Section III of Instruction 05 stipulates disciplinary action against party members who violate population policy regulations.
In particular, point 8.1 stipulates that if a party member violates the family planning measures that will affect maternity health (confirmed by a district-level hospital or higher) then the disciplinary level will be considered for reduction.
As for point 8.2 regulating the handling of party members who violate due to intentional or forced non-implementation of family planning, consideration should be given to increasing the disciplinary level.
At the same time, Instruction 15 also adds some contents in Clause 8, Section III of Instruction 05.
Accordingly, the act of stipulating in Clause 2, Article 1 of Ordinance 08/2008/PL-UBTVQH12 dated December 27, 2008 amending Article 10 of the 2003 Population Ordinance "having one or two children, except in special cases prescribed by the Government" shall not be considered for handling.
Instruction 15 of the Central Inspection Committee takes effect from March 20, 2025.
Thus, from March 20, party members having a third child or more will no longer be considered a violation to handle Party discipline.
Previously, the Central Party Office sent a document to the Central Inspection Committee, the Government Party Committee, the National Assembly Party Committee, and the Ministry of Health Party Committee to notify the Politburo's opinion on the preliminary implementation of Resolution 21 on population work in the new situation and amending the regulations of the Party and State related to population policy.
In particular, the Politburo assigned the Central Inspection Committee to advise and amend regulations of the Central Executive Committee, the Politburo, the Secretariat related to handling violations of population policies and proactively amending Instruction No. 05 of the Central Inspection Committee in the direction of not disciplining cases of having a third child or more, in sync with amending legal regulations (not recovering cases that have been disciplined).
