On April 28, the National Assembly Standing Committee gave its opinion on the draft Law on Organization of Local Government (amended).
At the meeting, Minister of Home Affairs Pham Thi Thanh Tra said that the draft clearly defines the authority of local authorities at two levels, thoroughly overcoming overlap and overlap in functions, tasks and powers of local authorities at all levels.
The regulations in the draft also focus on reducing units, abandoning intermediaries, streamlining the organizational structure, ensuring the unified, smooth, effective and effective operation of the administration from the central to the commune level; Building government near people, killing people, better serving the needs of people in the area.
Expressing the review's viewpoint, Mr. Hoang Thanh Tung - Chairman of the National Assembly's Committee on Law and Justice - agreed with the fundamental and comprehensive amendment of the draft law.
In addition, the Committee on Justice and Law recommends that the drafting agency continue to review, revise, and clarify a number of contents in the draft Law such as: Regulations on the number of People's Council (PCs) deputies at the provincial and commune levels.
The organization of specialized agencies and other administrative organizations under the People's Committees at the commune level to ensure compliance with local requirements and practices and the policy of streamlining the apparatus... also needs to be clarified.
Mr. Hoang Thanh Tung raised the question, should it be regulated that the People's Councils at the commune level get votes of confidence for positions elected by the People's Councils?
The Standing Deputy Head of the Committee for Petition and Supervision Le Thi Nga said that it is advisable to regulate the collection of votes of confidence at the commune level because there is no longer a district-level organization; moreover, the commune level is directly, close to the people.
Vice Chairman of the National Assembly Nguyen Khac Dinh also agreed that the People's Council at the commune level receiving votes of confidence for positions elected by the People's Council "is only good". However, the Government needs to report to the competent authority for comments.
Minister of Home Affairs Pham Thi Thanh Tra said that the Politburo's regulation does not take votes of confidence for positions at the People's Council and People's Committee at the commune level.
However, currently, the legal status, functions, tasks and specific activities of the new commune level are very different. Therefore, the drafting committee accepted the opinion to adjust in the direction of implementation after receiving the opinion of the competent authority.
At the meeting, Vice Chairman of National Assembly Nguyen Khac Dinh noted the regulation of the organizational structure of the commune. As a rule, the maximum commune -level payroll is 32 people and organized into many rooms, each room has 2 leaders including the head and deputy head, so is it reasonable?
"Commune cadres must be like a mixed sword, able to do many tasks, now dividing each person to work, sometimes leading to difficulties in mobilizing the overall force, especially when it is sudden and urgent" - Mr. Dinh expressed his opinion.
Regarding the organization of the commune-level apparatus, Minister Pham Thi Thanh Tra informed that it is expected that the number of commune-level leaders will account for over 1/3. For example, if there are 7 departments, there are purely 14 department leaders, not to mention leaders of the Party and government.
"There will be many more, so we are very impatient. This is a complete government level, so there must be a apparatus. Therefore, it is applied flexibly, that is, locally based on development scale, population... to be able to arrange specialized agencies and equivalents, or according to job position" - the Minister of Home Affairs expressed.
Emphasizing that the Government will have to provide detailed instructions on this issue, the Minister of Home Affairs said that if designing a organizational apparatus, leaders must be concurrently in charge, the goal is to best serve people and businesses.
