Officials and civil servants may be forced to resign if waste causes damage of over 75 million VND

Decree No. 267/2026/ND-CP of the Government stipulates that cadres, civil servants, and public employees may be forced to resign if waste causes damage of over 75 million VND.

The Government has issued Decree No. 267/2026/ND-CP detailing the application of disciplinary measures and compensation for damages for acts of causing waste and violations in organizing the implementation of waste prevention and control.

According to the Decree, heads and deputy heads who are irresponsible, lax in leadership and management, leading to acts of causing waste in agencies, organizations, units, businesses, and fields under their management and direct responsibility are considered for disciplinary action as follows:

The form of reprimand discipline is applied in cases where a wasteful act occurs and is criminally handled by a fine, non-custodial reform or imprisonment of up to 3 years.

The form of disciplinary warning is applied in cases where a wasteful act occurs and is criminally handled by imprisonment from 3 years to 7 years.

The form of dismissal discipline is applied in cases where a wasteful act occurs and is criminally handled by imprisonment from over 7 years to 20 years, life imprisonment or death penalty.

The Decree also stipulates the application of disciplinary measures to cadres, civil servants, and public employees who have acts of causing waste as follows:

1. The form of reprimand discipline applies to cadres, civil servants, and public employees who have acts of causing waste in one of the following cases:

- Having a first-time violation, causing damage from 2 million VND to less than 50 million VND;

- Having a first-time violation, causing damage from 50 million VND to 75 million VND and falling into one of the cases eligible for mitigating disciplinary action;

- Performing acts of not issuing or delaying the issuance, amendment, and supplementation of legal normative documents on norms, standards, and regimes in the field of thrift, anti-wastefulness, and causing waste.

2. The form of disciplinary warning applies to cadres, civil servants, and public employees who have acts of causing waste in one of the following cases:

- Having been disciplined in the form of reprimand but re-offending, except for cases considered for criminal responsibility;

- Having a first-time violation, causing damage from 50 million VND to 75 million VND.

3. The form of dismissal discipline applies to cadres, civil servants, and public employees holding leadership and management positions in one of the following cases:

- Having been disciplined in the form of a warning according to the provisions of Clause 2 above and re-offending, except for cases considered for criminal responsibility;

- Having an act of causing waste for the first time causing damage of over 75 million VND but not to the extent of forced dismissal, dismissal, the violator has an attitude of receiving, correcting, proactively remedying the consequences and falls into one of the cases eligible for mitigating the disciplinary level specified in Article 4 of this Decree.

4. The form of dismissal discipline applies to civil servants and public employees who have acts of causing waste in one of the following cases:

- Having been disciplined by dismissal for civil servants and public employees holding leadership and management positions or warning for civil servants and public employees who do not hold leadership and management positions but re-offend, except for cases considered for criminal responsibility;

- Having an act of causing waste for the first time causing damage of over 75 million VND, but the violator does not have an attitude of receiving, correcting, and proactively remedying the consequences and falls into one of the cases of increasing the level of discipline according to the provisions of law on disciplinary action against cadres, civil servants, and public employees.
