Continuing the 9th Session, on the afternoon of May 8, National Assembly delegates had group discussions and contributed opinions on 3 draft Laws, including: Law amending and supplementing a number of articles of the Law on Organization of People's Courts; Law amending and supplementing a number of articles of the Law on Organization of People's Procuracies; Law on Inspection (amended).

Regarding the Law on Inspection (amended), delegate Nguyen Quoc Luan - Member of the National Assembly of Yen Bai province assessed that amending the Law at this time is timely to institutionalize the Party's policy on streamlining the organization of the political system.

However, delegate Luan also pointed out a number of contents that need to continue to be reviewed and adjusted accordingly.

According to Article 18 of the Law on Inspection (amended), the inspection plan of the provincial inspectorate is established after the Prime Minister has approved, oriented the annual inspection program and the inspection plan of the Government inspectorate.

"However, now we have another step to ask for the opinion of the Government Inspectorate after the provincial inspectorate has a detailed plan. This could create unnecessary administrative procedures," said delegate Luan.

The Luan delegate said that the provincial inspectorate only inspects the tasks and activities of the locality. Therefore, it will be very difficult for the Government Inspectorate to give detailed opinions on this inspection plan, including both resources and time.

"And if the current remains, it must be clearly stated, after sending opinions, when the Government Inspectorate responded, it must be clear about the time, not to let the situation happen below, then wait and soak it," the discussion said and asked the drafting agency to consider this content.

Delegate Le Van Dung - Head of the National Assembly Delegation of Quang Nam Province (Deputy Head of Group 5) agreed with the above opinion and said that it was very close to reality.

According to delegate Dung, to inspect the Government for detailed opinions on all inspection plans of the provinces, it will take a long time - "there are times when the year-end inspection plan has not been approved for inspection", delegate Dung said.

Commenting on this issue, delegate Dung said that the Chairman of the Provincial People's Committee can approve the plan, implement and conclude the inspection. When the conclusion is available, the provincial inspectorate will submit it to the Government inspectorate for consideration and appraisal.

However, the delegate also suggested that there should be clear regulations on the time to draw the conclusion on the inspection results.

"In reality, there have been inspections that took up to 5 years to reach conclusions, causing many consequences. In particular, regarding personnel work, during the time of inspection and examination, cadres are not considered in the planning for appointment, introduction, and nomination.

If the inspection continues for a few years, it will affect the rights of cadres," said Delegate Le Van Dung.

Continuing to comment on the above issue, delegate Nguyen Quang Huan - National Assembly Delegate of Binh Duong province said that it is necessary to clearly define the responsibility of individuals and organizations related to the inspection that has lasted for many years without being able to conclude.

Citing reality, delegate Huan said that in Binh Duong, there was a case where an inspection that lasted for many years could not draw a conclusion for many reasons.

"I also questioned the Government Inspector General about this incident at the previous meeting. So in case the inspection results cannot be concluded, if the extension is repeated many times, who is responsible?

Article 25 of the draft Law also states that if there are problems in the previous inspection, a re-inspection will be conducted. If we have to re-inspect, that means the previous inspection was not good, who is responsible for this", delegate Huan commented.

Delegate Huan said that in the above issue, "regulations are strict but sanctions are not specific", and at the same time suggested that the drafting agency accept the opinions of delegates to consider, supplement or adjust them to suit reality.
