Continuing the 9th Session, on the morning of May 8, the National Assembly listened to Government Inspector General Doan Hong Phong, authorized by the Prime Minister, present the Draft Law on Inspection (amended).
Immediately afterwards, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung (UBPLTP) presented the Report on the review of the above draft Law.
Basically, the Organizing Committee approved the comprehensive amendment of the 2022 Inspection Law (current Law) with the reasons, political, legal, practical and viewpoints as stated in the Government's Submission.
This amendment to the Law aims to promptly institutionalize the Party's policy on streamlining the apparatus of the political system, including streamlining the inspection agency system to be streamlined, compact, strong, efficient, effective and efficient.
At the same time, the Organizing Committee highly appreciated the efforts of the drafting agency in developing and completing the draft Law dossier, ensuring eligibility to submit to the National Assembly for consideration.

However, the review report also clearly stated that some contents in the draft Law need to continue to be reviewed.
Regarding the duration of an inspection, Chairman of the National Assembly's Standing Committee for Food and Agriculture Hoang Thanh Tung said that the draft Law stipulates the duration of inspection in general and all steps in the process of inspection to be converted from a "day" to a "working day" without clearly and thoroughly explaining the reason.
The People's Committee of the People's Committee realized that, with this change, the time limit for conducting an inspection will last much longer, which can affect the normal operation of the inspection subject, not in line with the policy "in 2025 reducing at least 30% of the time to handle administrative procedures; reducing at least 30% of business costs, especially in the field of customs, the expenses of the State, the State has not been officially in the state.
"For example, the current deadline for conducting an inspection conducted by the Government Inspectorate is not more than 60 days, but according to the draft Law, it is not more than 60 working days, equivalent to 84 days (12 weeks), an increase of 40%.
If we count all 02 extensions, the maximum time limit for an inspection conducted by the Government Inspectorate will be 120 working days, equivalent to 24 weeks (06 months), which is too long", said Chairman of the National Assembly's Standing Committee Hoang Thanh Tung.
Therefore, the Organizing Committee proposes to consider not changing the unit for calculating "days" to "working days" as proposed in the draft Law.
At the same time, the Organizing Committee requested the drafting agency to review the regulations on inspection procedures in the draft Law to be able to reduce the deadline for some stages, ensuring compliance with the direction of competent authorities.

According to the Draft Law on Inspection (amended), inspections conducted by the Government Inspectorate must not exceed 60 working days; in complicated cases, they can be extended once for no more than 30 working days; in particularly complicated cases, they can be extended a second time for no more than 30 working days.
The inspection was conducted by the Ministry of Public Security Inspectorate, the Ministry of Defense Inspectorate, the State Bank Inspectorate, and the provincial Inspectorate shall not exceed 45 working days; In complicated cases or in mountainous areas, borders, islands, remote areas, difficulty traveling may be extended once for no more than 30 working days;
The inspection is conducted by the Inspectorate of the State Inspectorate or the Inspection Agency established under international treaties for no more than 30 working days; in case of complication or in mountainous, border, island, remote, or difficult-to-travel areas, it can be extended once for no more than 15 working days.
The inspection suspension period prescribed in Article 30 of this Law is not included in the inspection period.
