The Government has just issued Decree 217/2025/ND-CP dated August 5, 2025, regulating specialized inspection activities.
According to the Decree, specialized inspection is the consideration, assessment, and handling of competent agencies and individuals for compliance with specialized laws of agencies, organizations, and individuals (called organizations, individuals) under state management by industry and field.
Specialized inspection activities aim to rectify and raise awareness of compliance with specialized laws; prevent, detect, stop and apply or recommend competent agencies and individuals to apply measures according to the provisions of law to promptly handle violations; contribute to improving the effectiveness and efficiency of state management.
Through specialized inspections, request or request competent inspection agencies to conduct inspections when necessary; if there are signs of crime, recommend prosecution and transfer case files and related documents to the investigation agency for consideration and decision on criminal prosecution according to the provisions of law.
The Decree clearly stipulates prohibited acts in specialized inspection activities.
In particular, for those with the authority to conduct specialized inspections, it is strictly forbidden to take advantage of positions and powers to harass and cause trouble for organizations and individuals who are subjects of specialized inspections;
Illegal intervention in the activities of specialized inspectors;
Receiving bribes, gifts or material or spiritual benefits in any form from the subject of the specialized inspectorate;
Illegal use of information and documents collected during the specialized inspection process...
According to the Decree, Ministers and Heads of ministerial-level agencies have the authority to inspect specialized sectors under state management.
The head of a unit under a ministry or ministerial-level agency has the authority to conduct a specialized inspection of organizations and individuals within the scope of decentralization and authorization.
Department heads and equivalents under ministries and ministerial-level agencies have the authority to conduct specialized inspections of organizations and individuals under the scope of decentralization of management.
Chairmen of People's Committees at all levels have the authority to conduct specialized inspections of organizations and individuals under the state management of the People's Committees at the same level.
The head of the competent unit for specialized inspection under the ministry, the ministerial-level agency, the head of the specialized agency under the People's Committee at all levels to handle violations according to their authority or recommend competent authorities to promptly handle the agencies, organizations, and individuals who have violated the law on handling administrative violations; in case there are signs of crime, information should be forwarded to the investigation agency for consideration and handling according to regulations.
