The Government has just submitted to the National Assembly the draft Law on Organization of Local Government (amended). The draft law consists of 7 chapters and 50 articles (93 articles less than the current law).
The draft law basically inherits the provisions on the organizational structure of the People's Committee (PC) according to the provisions of current law and assigns the Government to prescribe the framework for the number of Vice Chairmen of People's Committees at all levels and the number of specialized agencies under the People's Committees at provincial and district levels.
The People's Committee at the local government level operates under a collective regime combined with the personal responsibility of the Chairman of the People's Committee and each member of the People's Committee.
Notably, the draft has detailed the tasks and powers of the provincial People's Committee.
Accordingly, the Provincial People's Committee shall draft and submit to the People's Council (PC) of the same level for consideration and promulgation of resolutions to perform the tasks and powers prescribed in this law; and organize the implementation of the resolutions after they are approved by the PC.
Organize the implementation of the Constitution and laws at the local level; ensure conditions of facilities, human resources and other resources to implement the Constitution and laws at the local level.
Responsible for coordinating with central and local government agencies to promote regional and local economic linkages, implement regional planning, and ensure the unity of the national economy.
Implementing state administrative management at the local level ensures unity, smoothness, continuity, effectiveness, efficiency, democracy, rule of law, professionalism, modern governance, cleanliness, openness, transparency, and service to the people.
Manage the number of civil servants in state administrative agencies, the number of officials receiving salaries from the state budget within the scope of management, the number of part-time workers at the commune, village, and residential group levels of the locality according to the provisions of law and decentralization of the superior state agency.
Regulate the organizational structure and specific tasks and powers of specialized agencies and other administrative organizations under the People's Committee at the same level; decide on the establishment, arrangement, dissolution and regulate the organizational structure and specific tasks and powers of public service units under the People's Committee at the same level according to the provisions of law.
Regulate the number of Vice Chairmen of the People's Committees at district and commune levels; regulate the establishment, arrangement and dissolution of specialized agencies and other administrative organizations under the People's Committees at district level according to the number framework prescribed by the Government.
The Provincial People's Committee promulgates the working regulations of the People's Committee at its level; performs assigned and delegated tasks and powers and other tasks and powers as prescribed by law.
The People's Committee of a centrally-run city shall perform the tasks and powers specified in Clause 1 of this Article and the following tasks and powers:
Draft and submit to the People's Council of the same level for consideration and promulgation of resolutions to perform the tasks and powers prescribed in this law; organize the implementation of resolutions after they are approved by the People's Council.
Decide on urban planning, programs, and plans for urban development and urban infrastructure according to the provisions of law; uniformly manage urban land funds and urban infrastructure in the city according to the provisions of law.
Co-decided to transfer a number of functions, tasks and powers as prescribed by law under the functions, tasks and powers of specialized agencies under the City People's Committee to the People's Committees of districts, towns and affiliated cities.
