The Ministry of Home Affairs has received a petition from voters in Tuyen Quang province transferred by the National Committee for People's Affairs and Supervision.
One of the contents proposed by voters in Tuyen Quang province is to issue a document establishing and unifying villages and residential groups nationwide: Below the commune is the village, below the ward is the residential group.
The Ministry of Home Affairs said that the Ministry is assigned to preside over and coordinate with relevant ministries, sectors, and localities to develop and submit to the Government for promulgation regulations on criteria and procedures for arranging villages and residential groups; guiding the arrangement and arrangement of non-specialized personnel for localities to organize implementation.
Currently, the Ministry of Home Affairs is studying and developing a draft Decree on the organization and operation of villages and residential groups and a number of regimes and policies for non-specialized workers to submit to the Government for consideration and decision.
Contents related to the election process for village heads and residential group heads, according to the Ministry of Home Affairs, are stipulated in the Law on Implementation of Democracy at the Grassroots Level and Decree 59/2023 of the Government detailing a number of articles of the Law on Implementation of Democracy at the Grassroots Level.
The Ministry of Home Affairs emphasized that these regulations are currently in effect and are still appropriate when implementing the 2-level local government model.
Article 3 of Decree 59/2023 clearly stipulates the organization of meetings of the residential community for people to discuss and decide.
Accordingly, the authority to convene, chair and organize meetings of the residential community is stipulated as follows:
Village heads and residential group leaders shall convene and preside over the organization of meetings of the residential community for people to discuss and decide on the contents specified in Clauses 1, 2, 3, 5 and 6 of Article 15 of the Law on Implementation of Democracy at the Grassroots Level.
The election team (established by the Chairman of the Commune-level People's Committee) convenes and chairs a meeting of the residential community to elect village heads and residential group leaders.
Heads of the Fatherland Front Work Committees in villages and residential groups convene and chair meetings of the residential community to dismiss village heads and residential group heads.
In case the village head, residential group leader is also the Head of the Fatherland Front Work Committee, the Chairman of the commune-level People's Committee shall convene and chair the meeting after agreeing with the Chairman of the Vietnam Fatherland Front Committee at the commune level.
In case there is a shortage of village heads or residential group leaders, the Chairman of the Commune-level People's Committee shall appoint representatives of the Fatherland Front Working Committee in the village or residential group or summoners who are reputable citizens residing in the village or residential group to summon and organize meetings of the residential community for people to discuss and decide on the contents except for cases specified in points b, c, clause 1 of this Article.
Village heads and heads of residential groups authorize a member of the Fatherland Front Working Committee in the village or residential group or a reputable citizen residing in the residential group to preside over and manage the meeting of the residential group and report the results to the village head and head of the residential group for synthesis into the general results of the entire village or residential group.
