The National Assembly Chairman said that he is very worried that when the apparatus is reorganized, there will be many establishments, public headquarters and assets that will be wasted.

Many headquarters are abandoned and not yet in use

On the morning of June 3, the National Assembly Standing Committee gave its opinion on the reception, explanation, and revision of the draft Law amending and supplementing a number of articles of the Law on Organization of People's Courts (TAND).

Speaking on this content, Politburo member and National Assembly Chairman Tran Thanh Man highly agreed with this amendment to supplement the law to serve the streamlining of the apparatus.

In addition, the National Assembly Chairman suggested clarifying regulations on the authority of the Regional People's Court; transitional regulations to ensure the process of transferring tasks and powers on the dossier goes smoothly. This is not to affect the rights of organizations and individuals.

It is necessary to focus on handling existing assets and facilities as well as paying attention to investing in modern facilities and equipment for the apparatus after the reorganization.

The National Assembly Chairman suggested paying attention to training the team of judges. Currently, in localities, the team of judges and court officials with heart, vision, talent, and virtue will meet the requirements of trial in the current situation, creating trust of people and businesses.

According to the Chairman of the National Assembly, coming here, the organization of the apparatus and property of the Court is very important. Most recently, General Secretary To Lam in the article "Savings practice" indicates the savings and combat waste are two components of organic attachment, two pillars to go to prosperity, rich for both family, country and society.

The press also provided a lot of information about the arrangement of administrative units that the National Assembly Standing Committee had done in the previous period. Among them, many public offices are abandoned, not yet sold, and have not been put into operation.

Expressing his great concern, the National Assembly Chairman said that in the coming time, the arrangement of the apparatus will not only be for the court but also for other agencies. If there is no plan to proactively use it immediately, many facilities, headquarters, and assets will be wasted.

"The new place is lacking, but the old place is not used up. This is an issue that we must calculate carefully," the National Assembly Chairman noted.

The National Assembly leaders suggested that the People's Court closely coordinate with the Law and Justice Committee to review and ensure consistency in other laws amended at the 9th Session. We must avoid legal gaps but also create a corridor for the operation of the court system.

Enterprises are not confident if they transfer the right to decide on arbitration

Vice Chairman of the National Assembly Nguyen Khac Dinh said that the agencies have basically agreed on all contents; only proposed to stipulate that specialized courts under international financial centers are at the general level of organization, while contents such as litigation will be stipulated in the resolution.

The Supreme People's Court's Judicial Council will be assigned to guide the principles of trial and promulgate the law for this specialized court.

Regarding arbitration, the current Law on Commercial Arbitration stipulates that the new provincial People's Court has the right to decide. Here, we do not judge the content, only judge whether the referee's handling applies the law or not, if not correct, then Mr.

Currently, the new draft law is being assigned to the regional court. However, through discussion, many delegates, lawyers, and experts have concerns, write letters to the National Assembly Standing Committee and propose to keep it as is, assign it to the provincial court because there is no director of appraisal, appeal, and just say it is done.

"In the local court, we are also afraid that our qualifications are limited. Another thing is that at that level, there is also a fear of negativity, if an arbitration decision is canceled, it will affect the investment environment. Businesses see that they are moving from the provincial court to the region and are not assured," said the Vice Chairman of the National Assembly.
