On the afternoon of May 23, Deputy Prime Minister Ho Duc Phoc chaired meetings with the Ministry of Finance and the State Bank on reviewing Decrees on decentralization and delegation of authority associated with the determination of the authority to implement the 2-level local government organization model in the financial and banking sectors.
According to the report of the Ministry of Finance, up to now, the Ministry has 313 contents, tasks, and authority to propose decentralization and delegation of authority stipulated in 75 legal documents.
Of which, the number of implemented contents (in laws and resolutions passed by the National Assembly at the 8th Session and guiding documents for implementation) is 58 contents (regarding planning, investment, management and use of public assets, bidding, State budget, securities, national reserves, business management, collective economy, business households, specific mechanisms and policies for local development).
The remaining contents that need to be decentralized and delegated are 255. Of which, 95 issues will be resolved in draft laws and resolutions submitted to the National Assembly at the 9th session. The expected content to continue to be implemented in the coming time is 160 contents ( Regarding the 2-level model and decentralization and delegation of authority).
In which, the tasks and powers of the National Assembly, the National Assembly Standing Committee decentralize to the Government, the Prime Minister, and local governments, which are 21 contents.
Tasks and authority of the Government to decentralize to the Prime Minister, the Government and the Prime Minister to decentralize the Minister of Finance; The Government and the Prime Minister decentralized to the local government 42 contents.
The total duties and authority transferred from the commune level to the commune level is 73 contents. In particular, transferring tasks and authority from the district People's Committee to the commune -level People's Committee is 52; transfer and duties of competence from the Chairman of the district People's Committee to the Chairman of the People's Committee of the commune is 21.
Transferring tasks and authority from the district People's Committee to the provincial People's Committee is 5; transfer tasks and authority from the Chairman of the district People's Committee to the Chairman of the provincial People's Committee is 1.
The Ministry of Finance said that, implementing the instructions on the arrangement of administrative units, the Ministry has urgently developed Decrees related to promoting decentralization, delegation of power and arrangement of local government organizations at 2 levels.
After listening to reports and opinions from ministries and branches, speaking at the meeting, Deputy Prime Minister Ho Duc Phoc suggested that the Ministry of Finance study and clarify the determination of some competencies related to determining statistical targets at the provincial and commune levels;
Research related to decentralization of tax-security for import-export goods; special attention to decentralization of authority in the field of budget collection, tax management when not organized at the district level as well as investment decision-making authority...
Deputy Prime Minister Ho Duc Phoc suggested that the Ministry of Finance continue to review and specifically compile statistics on tasks, consider and calculate specific, detailed, scientific, complete, and comprehensive to determine appropriate and effective decentralization, delegation of authority, and division of authority.
After listening to the opinions of the Ministry of Justice, the Ministry of Home Affairs, the Government Office, speaking at the meeting, Deputy Prime Minister Ho Duc Phoc stated that the State Bank did not organize at district and commune levels; This field has ever been very strict so there is no problem. Some issues that need to be processed have been submitted in the Law on Credit Institutions (amended).
At the meeting, Deputy Prime Minister Ho Duc Phoc and representatives of ministries and branches also requested the State Bank of Vietnam to continue studying the content of decentralization, delegation of authority, and division of authority between the Government, the Prime Minister and the Governor of the State Bank for appropriate proposals and advice.
