The Government has just issued Decree No. 334/2026/ND-CP stipulating the autonomy of higher education institutions and vocational education institutions; financial mechanism for higher education and vocational education; national key program for full-time doctoral training.
The Decree stipulates that public educational institutions exercise autonomy in terms of organizational structure and personnel according to relevant legal regulations, including:
Promulgate regulations on the organization and operation of educational institutions; decide on the organizational structure, establishment, reorganization, dissolution of affiliated and directly affiliated units; decide on job positions and the number of employees within the scope of autonomy projects and development strategies approved by competent authorities and in accordance with the promulgated organization and operation regulations; and at the same time publicize, report and be responsible for the decisions of public educational institutions.
Decision approving the job position, number of employees and management of public employees of educational institutions according to regulations; arranging the number of deputy heads according to the autonomy project of educational institutions approved by competent authorities according to regulations; decision appointing the chief accountant or arranging people to be in charge of accounting.
For civil servant positions under management authority, educational institutions decide on the recruitment, evaluation, classification of civil servants, appointment, reappointment, assignment of powers, assignment of responsibility, extension of the term of office, dismissal from office, temporary suspension, suspension of office, resignation, dismissal, transfer, rotation; approve planning;
Public employees are sent for training and fostering; dismissal, transfer; disciplinary action; arrangement, assignment of work, change of job position; implementation of salary regimes; annual leave regimes, unpaid work leave, retirement and social insurance regimes; management of public employee records according to regulations.
Educational institutions issue and organize the implementation of internal regulations on organizational structure and personnel; exercise other autonomy rights on organizational structure and personnel according to the provisions of law.
Educational institutions are responsible for updating, managing and synchronizing data on civil servants and employees with the national database and specialized databases according to regulations.
