The Government has just issued Decree No. 290/2026/ND-CP amending and supplementing a number of articles of Decree No. 06/2013/ND-CP dated January 9, 2013 of the Government regulating the protection of agencies and businesses.
According to new regulations, security professional training and fostering is organized and certified by the Provincial Police or equivalent level.
Security forces of agencies and businesses are trained and fostered in legal knowledge, security nghiệp vụ, skills in using support tools, equipped equipment and skills in handling situations directly serving the performance of tasks of security forces of agencies and businesses.
The Decree also amends and supplements the tasks of the forces protecting agencies and businesses as follows:
1. Implement professional measures according to the provisions of law and professional guidance on protection of the Police force to prevent, detect and prevent acts of violating the law, violating regulations on protection of agencies and enterprises; promptly propose handling measures to the heads of agencies and enterprises.
2. Directly control people entering and leaving agencies and businesses. When incidents related to security, order and safety of agencies and businesses occur, they must organize scene protection, protect the property of agencies and businesses, provide first aid to victims, arrest criminals red-handed and immediately report to the nearest police agency.
3. Implement regulations on fire prevention and fighting, and maintaining public order.
4. Being the core in the all-people movement to protect national security in agencies and businesses; building safe agencies and businesses.
5. Coordinate with the Police of communes, wards, special zones and forces participating in protecting security and order at the grassroots level where agencies and enterprises are located in grasping the situation, ensuring security, order, and safety of agencies and enterprises; propose to the heads of agencies and enterprises to develop internal regulations to protect agencies and enterprises, plans and measures to prevent and combat crimes and other violations of the law in agencies and enterprises.
6. Implement regulations on the management of rudimentary weapons, supporting tools, explosives, flammable substances, and toxic substances (if any); assist heads of agencies and businesses in coordinating with the Police agency to manage and educate people with previous convictions, people who have complied with other administrative violation handling measures working at agencies and businesses.
7. Coordinate with mass organizations in agencies and businesses to propagate and disseminate laws to raise vigilance for everyone; guide mass organizations to participate in protecting security, order, and safety in agencies and businesses.
Regarding the powers of the security force of agencies and businesses as follows:
Inspect and urge departments, units and officials and employees in agencies and enterprises to implement the provisions of law on security, order and internal regulations for protecting agencies and enterprises.
While on duty, papers, goods, and vehicles entering and leaving agencies and businesses are inspected if there are signs of legal violations or violations of internal regulations of agencies and businesses.
Conduct verification of cases and incidents occurring in agencies and businesses under the authority assigned by the head of the agency or business or at the request of a competent Police agency.
Refuse to perform illegal requests while performing protection duties and must report to functional agencies for handling according to the provisions of law.
The above regulations take effect from September 15, 2026.
