Disciplinary civil servants will be classified as not completing their tasks

Civil servants who are subject to party discipline or administrative discipline during the year of assessment will be classified as "not completing the task" in quality, except for some cases.

This is one of the notable contents in the draft Decree on the assessment and classification of civil servant quality drafted by the Ministry of Home Affairs.

Accordingly, the principles for implementing the assessment and classification of civil servant quality include: Ensuring democracy, publicity, fairness, accuracy, transparency, objectivity, consistency, continuity, and multidimension; nowalking, bureaucracy, or discrimination.

Combining determinative criteria with qualitative criteria. Prioritize measuring output results and task performance.

Applying science and technology, digital transformation in monitoring, evaluating, and classifying civil servant quality (using civil servant assessment software).

Civil servants on sick leave with a total of 3 months or more in the year or maternity leave will have their quality classification results for the year based on the actual work results of that year.

The results of the assessment and classification of civil servant quality according to the provisions of this Decree shall be used as a basis for evaluating and classifying the quality of party members.

Civil servants holding many leadership and management positions are evaluated and classified as having the highest quality of civil servants in their positions. In case civil servants hold multiple equivalent positions and titles at the same time, the quality will be assessed and classified annually in places with more working time.

In particular, civil servants subject to party discipline or administrative discipline are evaluated and classified as follows:

Civil servants subject to party discipline or administrative discipline in the year of assessment shall be classified as not completing their tasks, except for the cases specified in Point b of this Clause;

In case the violation has not yet been disciplined by the competent authority but has been used as a basis for evaluating and classifying quality to the extent of not completing the task in the assessment year, the decision to handle the disciplinary action issued after the assessment year for that violation (if any) will not be counted for evaluation and classification of quality in the year of the decision to handle the disciplinary action;

In case a civil servant is a Party member, has been subject to party discipline and administrative discipline for the same violation but the decision to discipline the Party and the decision to discipline the administrative discipline are not effective in the same year of assessment, it will only be considered the basis for classifying quality in one year of assessment.

In addition, the rate of civil servants classified as "Completing tasks excellently" among the total number of civil servants at the same agency, organization, unit and for each group of subjects with similar tasks does not exceed the rate of party members classified as "Completing tasks excellently" according to Party regulations.

In case the agency, organization or unit has outstanding and outstanding achievements, completes assigned tasks well beyond the plan, has proposals or organizes innovation and creativity to create positive changes, bringing value and practical efficiency, the competent authority shall decide on the rate of excellent completion of tasks in accordance with reality, ensuring the legitimate rights and interests of civil servants.
