The Ministry of Home Affairs is soliciting opinions on the draft Law on Civil Servants (amended), expected to be submitted to the National Assembly at the 10th session, taking place in October.
Notably, the Ministry proposes that when public service units have a need, civil servants can be transferred to new job positions if they meet the professional and technical standards of that job position.
The selection of civil servants for the remaining job position is carried out by the head of the public service unit or the competent agency or unit managing the public service unit according to the principles of equality, publicity, transparency, objectivity and compliance with the law.
When switching to a new job position, the amendment and supplementation of the content of the work contract shall be implemented in accordance with the provisions of this Law; the change of professional title of civil servants shall be implemented in accordance with the provisions of this Law.
In addition, the draft Decree also clearly states the basis for determining the position of civil servants as clearly stated in the draft Decree, including: functions, tasks, powers, and organizational structure of public service units.
The level of complexity, nature, characteristics, and scale of activities; scope, service subjects; professional and technical management processes according to the provisions of specialized laws.
The level of modernization of offices, equipment, working facilities, application of information technology, digital transformation.
The job position of civil servants includes the following main contents: job position name; Corresponding positions and professional titles of civil servants; Job description and job position capacity framework.
The Ministry of Home Affairs has proposed to classify job positions: Management job positions; Professional and technical job positions;
Support and service job position; Other job positions in line with the model of public service unit organization.
The Government shall prescribe principles, order, and procedures for construction, the authority to approve job positions, and detail this Article.
