General Phan Van Giang affirmed that the business of unmanned aerial vehicles must have conditions and be associated with management responsibility.

Discussing at the group discussion session on August 4th on the draft Law amending and supplementing a number of articles of 9 laws on military and defense, National Assembly deputy Trinh Xuan An - Specialized Member of the National Assembly's Committee for National Defense, Security and Foreign Affairs proposed not to remove the type of drone business from the list of conditional business lines.

According to the delegate, if reviewing the draft laws being submitted to the National Assembly, it will be seen that there is inconsistency between the draft Law amending and supplementing a number of laws on military and national defense and the draft Law amending and supplementing Article 6 and Appendix IV on the list of conditional business lines of the Investment Law.

The delegate said that the regulations in the draft Law amending and supplementing a number of laws on military and national defense are appropriate.

According to the draft Law amending and supplementing a number of articles of 9 laws on military and defense that are being submitted to the National Assembly for comments, organizations and individuals trading in unmanned aerial vehicles, other aircraft, aircraft engines, aircraft propellers and equipment and equipment of unmanned aerial vehicles, other aircraft must meet the regulations of conditional business investment sectors, market access sectors for foreign investors and ensure sufficient maintenance of those conditions throughout the business operation process according to the provisions of law.

Meanwhile, the draft Law amending and supplementing Article 6 and Appendix IV on the list of conditional business lines of the Investment Law is also being submitted to the National Assembly for comments, which has removed the business line "Business of unmanned aerial vehicles, other aircraft, aircraft engines, aircraft propellers and equipment, equipment of unmanned aerial vehicles, other aircraft" from the list of conditional business lines.

Delegate Trinh Xuan An also emphasized that management is not only limited to business licensing but also includes registration, inspection and flight licensing.

If only simply abolishing conditional business lines, it will certainly not solve the problem," delegate Trinh Xuan An expressed his opinion.

According to delegate Trinh Xuan An, maintaining business conditions is not intended to create additional barriers for businesses, because there is a decree of the Government clearly stipulating cases where licensing is required, not licensing, as well as import, production, and business activities serving socio-economic development.

Regarding the delegates' opinions, General Phan Van Giang - Member of the Politburo, Deputy Prime Minister, Minister of National Defense affirmed that the business of driverless vehicles must certainly have conditions.

According to the General, the draft Law only adjusts the management authority from the Ministry of Industry and Trade to the Provincial People's Committee, while the requirements on business conditions must still be maintained.

If there is a shortage, it must be supplemented," General Phan Van Giang emphasized.

Regarding licensing authority, General Phan Van Giang said that any agency assigned to implement it is okay, but it must be associated with management responsibility.

The licensing agency must be responsible for managing that vehicle. If a license is issued but cannot be managed, it will potentially affect national defense, security and aviation safety.

General Phan Van Giang also emphasized that the determination of the licensing agency is not a matter of power between ministries and sectors, but the goal is to clearly define management responsibilities to both create conditions for economic development and ensure the requirements of protecting airspace and national security.
