The Ministry of Home Affairs has issued a document requesting the People's Committees of provinces and cities to review and report on the implementation of the policy of decentralization, delegation of authority, and division of authority according to the 2-level local government model.
The document clearly stated that, implementing the conclusions of General Secretary To Lam, Head of the Central Steering Committee on perfecting institutions and laws, in order to have a basis to report to the Politburo and the Secretariat on the implementation of assigned tasks and powers, the Ministry of Home Affairs proposed that the People's Committees of provinces and cities implement a number of contents.
Localities assess the feasibility, convenience, and difficulties in implementing regulations on decentralization, delegation of authority, and division of authority of regulations in decrees, circulars, and other legal documents.
In particular, focusing on the contents of tasks and authority that have been delegated to local authorities at the commune level for implementation.
In case of difficulties or problems in implementation, the Ministry requests the People's Committees of provinces and cities to send documents to ministries managing sectors and fields for synthesis, research completion or guidance according to their authority; at the same time, send them to the Ministry of Home Affairs for synthesis and reporting.
Previously, the Ministry of Home Affairs requested ministries, branches and localities to review 3 decrees, including Decree 128 on decentralization and delegation of authority in State management of the Home Affairs sector; Decree 129 on decentralization of authority of local authorities at 2 levels in the field of state management of the Ministry of Home Affairs; Decree 152 regulating decentralization and delegation of authority in the field of emulation and rewards; detailing and guiding the implementation of a number of articles of the Law on Emulation and Rewards.
At the same time, review Circular 09 on the division of authority and decentralization of the implementation of state management tasks in the field of internal affairs; Circular 10 guiding the functions, tasks and powers of internal affairs departments under the People's Committees of provinces and cities and the internal affairs field of specialized departments under the People's Committees of communes, wards and special zones under provinces and cities.
Accordingly, this review is to determine whether there are still conflicts, overlaps, does not ensure consistency or is not specific and clear enough when organizing a 2-level local government model in the field of internal affairs.
From there, identify difficulties and problems, propose solutions to resolve them due to legal regulations or other related causes.
