The draft Law on Civil Status Registration (amended) has been considered and commented on by the National Assembly Standing Committee.
According to the draft, this Law stipulates civil status; rights, obligations, principles, powers, methods of implementing civil status registration; Civil status database and state management of civil status.
The draft Law also stipulates that the People's Committee (PC) at the commune level shall register all events and civil status information. Accordingly, people have the right to request civil status registration at any Commune-level PC, regardless of place of residence or administrative boundaries.
At the same time, this Law also supplements the authority to register for supervision of guardianship, terminate supervision of guardianship related to the assets of the person being guardianized regardless of the place of residence of the individual to implement the requirements of comprehensive innovation in resolving administrative procedures and providing public services regardless of administrative boundaries.
Regarding the authority and obligation to register civil status, the draft Law supplements regulations on the rights and obligations to register civil status of people of Vietnamese origin who have not yet determined their nationality and reside in Vietnam; regulations to ensure the right to register birth registration for children born in Vietnam or living in Vietnamese territory.
Regarding resolving civil status registration requirements, the draft Law stipulates the authority, subjects, and scope of each civil status registration procedure, assigning the Government to specifically regulate dossiers, procedures, and deadlines for civil status registration because these are contents that are easily fluctuating and changing according to actual time.
The draft Law supplements regulations that the civil status registration agency is responsible for proactively exploiting and searching for information on the relevant database in accordance with the response level of the database.
At the same time, only require people to submit and present documents if information cannot be exploited or the exploited information is incomplete and inaccurate...
This draft law stipulates prohibited acts such as: Providing false information and documents; making or using fake documents, other people's documents to register civil status; threatening, coercing, obstructing the exercise of civil status registration rights and obligations; illegally interfering in civil status registration activities.
Or prohibit making false commitments and testimonies to register civil status; prohibit forging, correcting, or falsifying the content of civil status documents or information in the Civil Status Book, Civil Status Database.
The draft law also mentions the prohibition of bribery, corruption, promising material and spiritual benefits to be registered for civil status; prohibiting taking advantage of civil status registration or evading civil status registration obligations for self-interest motives, enjoying preferential policies of the State or profiteering in any form...
