On September 30, according to Lao Dong reporters' investigation, after the 7th session of the 15th National Assembly, voters in Quang Ninh and Khanh Hoa provinces sent petitions related to the regime and policies for the militia and self-defense forces.
Accordingly, voters of Quang Ninh province reflected that the regimes, policies, and support levels as prescribed in Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on the organization and building of forces and regimes and policies for militia and self-defense forces are regulated by specific monetary levels.
However, according to the new basic salary policy, the basic salary has increased from VND 1,800,000 to VND 2,340,000, but the policies and regimes under Decree 72 still apply the specific amount of money built at the time of the old basic salary; the application will no longer be suitable and outdated.
Voters of Quang Ninh province recommend that the Ministry of National Defence study and report to the Government to soon amend and supplement the provisions in Decree No. 72/2020/ND-CP so that current support levels must be consistent with the new basic salary policy; at the same time, improve the quality of policy development, accordingly, regimes and policies need to be built using coefficients based on basic salaries instead of stipulating specific amounts of money.
Similarly, voters of Khanh Hoa province stated that in Article 7 of Decree No. 72/2020/ND-CP regulating the allowance regime for the position of militia and self-defense commander, voters proposed to review and amend Decree 72/2020/ND-CP to ensure the regimes when adjusting the basic salary level.
Responding to these contents, the Ministry of National Defence said that in 2022, the Ministry of National Defence chaired and coordinated with ministries, branches and localities to summarize and agree on proposals to amend and supplement a number of articles of Decree No. 72/2020/ND-CP.
On July 14, 2023, the Ministry of Justice issued Appraisal Report No. 123/BCTD-BTP on the draft Decree. The Ministry of National Defence has studied and fully absorbed the opinions of agencies, organizations, localities and the appraisal opinions of the Ministry of Justice, revised and completed the draft Decree (adjusting the level of enjoyment of a number of regimes and policies for militia and self-defense forces according to the current basic salary level).
On February 8, 2024, the Ministry of National Defence issued Report No. 523/BC-BQP explaining the acceptance of the Government's leadership's direction on the draft amendment and supplement to a number of articles of Decree No. 72/2020/ND-CP.
The scope of adjustment is to increase the level of enjoyment of some regimes and policies of the Militia and Self-Defense Forces, the level of enjoyment of allowances for Militia and Self-Defense Forces command positions; the level of ensuring regimes and policies for each militia and self-defense force component; the agency responsible for ensuring funding, regimes and policies for militia and self-defense forces not participating in social insurance and health insurance.
However, up to now, Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government stipulates that from July 1, 2024, the basic salary is 2,340,000 VND/month, so the Ministry of National Defence continues to draft an adjustment to increase the level of enjoyment of a number of regimes and policies for militia and self-defense forces according to the basic salary of 2,340,000 VND/month, submitted to the Government.
After the Decree is promulgated, the competent authorities will guide its implementation according to regulations.
