The Ministry of Home Affairs is soliciting comments on the draft Circular regulating the criteria for classification, conditions for establishing, reorganizing, and dissolving public service units in the archival sector.
According to the submission of the Department of Organization and Personnel (Ministry of Home Affairs), the development of this Circular is necessary to implement Resolution No. 19-NQ/TW of the 12th Central Executive Committee on continuing to innovate the organizational and management system, improving the quality and efficiency of public service units.
Resolution No. 19-NQ/TW requires the completion of legal regulations on criteria for classification, conditions for establishment, merger, consolidation, and dissolution of public service units in each industry and field.
According to the Ministry of Home Affairs, classifying public service units according to the management subjects as archival documents of ministries, branches of central agencies and public service units managing archival documents by territory in localities;
Promote the conversion of the operating mechanism of public service units towards autonomy, self-guaranteeing operating costs; effectively using State resources, enhancing the autonomy of public service units.
Arrange and perfect the apparatus to streamline, restructure the staff to ensure quality and determine appropriate job positions to improve operational efficiency; ensure the specificity of each field, maximize the technical facilities and existing staff.
Notably, in the draft Circular, the Ministry of Home Affairs proposes the conditions for dissolving public service units in the archival sector in Article 7.
Firstly, the dissolution of public service units in the archival sector is carried out when one of the conditions specified in Points a, b, c, d, Clause 3, Article 5 of Decree No. 120/2020/ND-CP is met:
a) No longer have the function or task of providing public service, serving state management;
b) Not meeting the criteria for establishing a public service unit as prescribed by law;
c) Three consecutive years of ineffective operations as assessed by competent authorities;
d) Implement according to the national sectoral planning or the network planning of public service units (if any) approved by competent authorities;
Second, public service units will only dissolve after fulfilling their obligations regarding finance, assets, land, loans, payables, and other obligations as prescribed by law and being confirmed in writing by competent authorities and organizations.
