The Ministry of Home Affairs proposes to dissolve administrative units of districts, towns and cities under provinces and cities under centrally-run cities, towns and cities from July 1, 2025.

Minister of Home Affairs Pham Thi Thanh Tra has signed a Submission to the Government on the draft Law on Organization of Local Government (amended).

Accordingly, the draft Law amends and supplements regulations on the organization of administrative units and the model of local government at two levels, including the provincial and commune levels, not district-level organizations.

The provincial level remains as per current regulations (including: Provinces and centrally run cities). Along with that, reorganize the current commune-level administrative units to form new commune-level administrative units including: Communes, wards and special zones (on islands).

The draft Law stipulates that local authorities at the provincial and commune levels both organize People's Councils and People's Committees to ensure a unified and smooth operation of the government apparatus from the Central to the commune level.

In parallel with the proposal of regulations on the organization of administrative units and the 2-level local government model, the draft Law on Organization of Local Government (amended) also has regulations to resolve arising issues related to the conversion of the local government organization model from 3 levels to 2 levels.

To ensure the operation of local governments when converting the government model to 2 levels continuously, smoothly, without interruption of work, and without overlap, the draft Law stipulates the effective date from July 1, 2025; Amend, supplement, and abolish relevant Laws and Resolutions of the National Assembly.

Notably, in the draft Law, the Ministry of Home Affairs proposes to dissolve administrative units of districts, towns and cities under provinces and cities under centrally-run cities, towns and cities from July 1, 2025.

The People's Council, agencies under the People's Council, People's Committee, Chairman of the People's Committee, specialized agencies under the People's Committees of districts, towns under provinces and cities under centrally-run cities and towns shall terminate their duties, powers and operations from July 1, 2025, except for the cases specified in Clause 7, Article 51 of this draft Law.

The organization of local government of the town after the arrangement and dissolution shall comply with the provisions of Chapter VI of this draft Law.

At the same time, the draft Law also stipulates the termination of the organization of the urban government model currently implemented in Hanoi, Ho Chi Minh City, and Da Nang City.

The draft Law also stipulates the transition in the organization of local government in wards in Hanoi, Ho Chi Minh City, and Da Nang City for the 2021-2026 term.
