The Ministry of Home Affairs has completed and sent its opinions on the draft Submission and draft Law on Cadres and Civil Servants as amended.
The Law on the Law on cadres and civil servants amended basically and comprehensively the provisions of the Law on Cadres and Civil servants, and regulations on cadres and civil servants; Election, recruitment, use and management of cadres and civil servants; obligations and rights of cadres and civil servants and conditions to ensure public service execution.
The bill is expected to be submitted to the National Assembly at the upcoming 9th session.
In Chapter IV on cadres, the Ministry of Home Affairs clearly states the regulations on leaving the job, resigning, dismissing and retiring cadres.
The Ministry of Home Affairs proposes that cadres cease their duties, resign, or be dismissed from their duties in the following cases: Not healthy enough; not qualified enough, not prestigious enough; according to task requirements; other reasons.
The authority, order, and procedures for resignation, resignation, and dismissal shall be implemented in accordance with the provisions of law and the competent authority.
Cadres are entitled to retire according to the provisions of the Labor Code.
6 months before, up to the date of retirement officers, agencies, organizations and management units must notify officials in writing the time of retirement; 3 months before, up to the date of retirement officers, agencies, organizations and management units issued to make retirement decisions.
In special cases, cadres holding positions from Ministers or equivalent or higher may have their working time extended according to the provisions of competent authorities.
