On March 24, the Ho Chi Minh City Department of Home Affairs submitted a document to the Ho Chi Minh City People's Committee on registering to draft a resolution to abolish Resolution 01/2025 of the Ho Chi Minh City People's Council on the additional support regime for cadres, civil servants, public employees and workers who quit their jobs when the city implements the restructuring of the organizational apparatus and restructuring administrative units.
Resolution 01/2025 was approved by the Ho Chi Minh City People's Council on February 20, based on Clause 6, Article 19 of Decree No. 178/2024 of the Government: "The People's Committees of provinces and centrally run cities shall, based on the ability to balance local budgets, submit to the People's Councils of the same level to issue additional support policies for subjects under their management".
In addition to the general policy under Decree 178/2024, Ho Chi Minh City also applies a separate support mechanism. In total, the city plans to spend about VND17,000 billion to support 7,159 cadres, civil servants and public employees subject to staff streamlining.
However, recently, the Government issued Decree 67/2025, amending and supplementing a number of articles of Decree 178/2024. Notably, Decree 67/2025 has abolished Clause 6, Article 19 - the content allowing the People's Committees of provinces and centrally run cities to submit to the People's Councils at the same level to issue additional support policies from the local budget.
This means that the legal basis for the Ho Chi Minh City People's Council to issue Resolution 01/2025 is no longer valid. Therefore, the additional support policy for cadres and civil servants when implementing the organizational arrangement and streamlining the payroll must be stopped.
In particular, cases that have been approved for support by competent authorities as prescribed in Clause 6, Article 19 of Decree 178 before March 15, 2025 will continue to enjoy this support policy.
According to information from the Ho Chi Minh City Department of Home Affairs, from January 1 to March 20, this agency received 281 applications for resignation or early retirement. Of which, there were 237 cases of early retirement and 44 people voluntarily resigned.
To ensure the rights of employees according to the new regulations, the Ho Chi Minh City Department of Home Affairs is proposing to establish an appraisal Council to consider each specific case. The support level will be calculated based on Decrees 178/2024 and 67/2025, taking into account the age, duration of social insurance payment and salary of each individual.
