The Ministry of Home Affairs responds to the receipt of attractive allowances for civil servants

According to the Ministry of Home Affairs, Article 4 of Decree No. 76/2019/ND-CP stipulates the attractive allowance regime for cadres, civil servants and public employees.

Mr. Le Van Binh (character's name has been changed) is a civil servant working in a commune with particularly difficult socio-economic conditions since 2008.

In 2010, the Government issued Decree No. 116/2010/ND-CP regulating policies for cadres, civil servants, public employees and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions.

Mr. Binh was entitled to an attraction allowance from March 2011 to December 2014 and was not entitled to it from 2015 to April 2018.

However, from April 2018 to now, he has been entitled to attraction allowances according to the provisions of Decree 76/2019/ND-CP. Mr. Binh questioned this allowance.

Regarding the reflection and recommendation of Mr. Le Van Binh, the Ministry of Home Affairs has responded on the Electronic Information Portal.

According to the Ministry of Home Affairs, Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions will take effect from December 1, 2019 (replacing Decree No. 116/2010/ND-CP dated December 24, 2010 of the Government), in which Article 4 of this Decree stipulates the attraction allowance regime.

Accordingly, the subjects specified in Article 2 of this Decree are entitled to a vocational allowance equal to 70% of the current salary (according to the salary table prescribed by the competent authority of the Party and State) plus leadership position allowance, seniority allowance exceeding the framework (if any) applied to actual working time in areas with particularly difficult socio-economic conditions not exceeding 5 years (60 months).

Along with the general provisions of Decree No. 76/2019/ND-CP mentioned above, the organization and implementation of policies for cadres, civil servants and public employees in Kon Tum province is under the authority of the People's Committee of Kon Tum province.

Therefore, the Ministry of Home Affairs recommends that you contact the agency managing cadres, civil servants and public employees of Kon Tum province (Department of Home Affairs) for answers.
