In the Draft Decree on the organization and operation of villages and residential groups and regimes and policies for non-specialized workers in villages and residential groups that are being consulted, the Ministry of Home Affairs proposes to establish villages and residential groups in special cases.
Accordingly, in case of establishing a ward from a commune, the Commune People's Committee shall develop a plan to convert existing villages into residential groups in the dossier of the ward establishment project submitted to competent authorities for approval. From the date the Resolution of the National Assembly Standing Committee on the establishment of wards takes effect, villages are allowed to be converted into residential groups.
In case the newly formed residential area does not meet the conditions for establishing villages and residential groups according to regulations, the Chairman of the Commune-level People's Committee shall issue a decision to merge the residential cluster into the existing village and residential group to be appropriate and ensure convenience in the management of the commune-level government and the activities of the village and residential group.
For villages and residential groups that have been formed for a long time due to intrusive cultivation and settlement but do not change the administrative boundaries of commune-level units, the relevant commune-level People's Committee shall agree to implement the transfer of the residential community to facilitate the management and living activities of the residential community. After implementing the transfer:
The People's Committee of the commune where the village or residential group is located, before transferring, implements the dissolution of the village or residential group or adjusts the management scope of the relevant village or residential group;
The commune-level People's Committee where receiving the residential community shall implement the establishment of new villages and residential groups if it ensures the criteria and conditions according to the provisions of this Decree; in case the criteria and conditions are not met, it shall implement the merger into existing villages and residential groups.
