Proposing the Commune People's Committee to get people's opinions on the plan to arrange villages and residential groups

The Ministry of Home Affairs proposed that commune-level People's Committees must consult people's opinions before deciding to rearrange and reorganize villages and residential groups.

In the Draft Decree on the organization and operation of villages and residential groups being consulted, the Ministry of Home Affairs proposes the order and procedures for rearrangement and reorganization; dissolution, naming, and renaming of villages and residential groups.

In case of arranging and reorganizing villages and residential groups to establish new villages and residential groups, the Commune-level People's Committee shall develop a Project on arranging and reorganizing villages and residential groups according to the order, procedures, and dossiers specified in Article 8 and submit it to the Commune-level People's Council for consideration and promulgation of a Resolution on arranging and reorganizing villages and residential groups to establish new villages and residential groups at the nearest meeting.

In case of dissolution of villages and residential groups, it shall be implemented as follows:

The commune-level People's Committee shall prepare a Submission attached to the List of households in villages and residential groups subject to dissolution;

Commune-level People's Committees organize to collect people's opinions on the Submission on the dissolution of villages and residential groups according to the provisions of law on implementing democracy at the grassroots level; are responsible for summarizing, explaining, and fully absorbing people's opinions; building into reports to complete dossiers to submit to the Commune-level People's Council for consideration and decision.

The dossier submitted to the Commune-level People's Council includes: A submission attached to the List of households in villages and residential groups subject to dissolution and a summary report, explanation, and full acceptance of people's opinions submitted to the Commune-level People's Council for consideration and decision.

Based on the dossier submitted by the Commune-level People's Committee, the Commune-level People's Council considers issuing a Resolution on dissolving villages and residential groups at the nearest meeting.

In case of renaming villages and residential groups, it is implemented as follows:

The commune-level People's Committee shall develop a Plan to change the name of villages and residential groups (the plan should clearly state the reasons for changing the name of villages and residential groups; the name of villages and residential groups after changing names...);

Commune-level People's Committees organize to collect people's opinions on the Plan to rename villages and residential groups in appropriate forms according to the provisions of law on implementing democracy at the grassroots level and are responsible for summarizing, explaining, and fully absorbing people's opinions; develop into reports to complete dossiers to submit to the Commune-level People's Council for consideration and decision.

Dossiers for renaming villages and residential groups include: Submission and Plan for renaming villages and residential groups and Summary Report, receiving and explaining opinions of the People;

Based on the dossiers of the Commune-level People's Committee, the Commune-level People's Council will consider and issue a Resolution on renaming villages and residential groups at the nearest meeting.

In places where local government level is not organized, the commune-level People's Committee shall prepare dossiers for arranging and reorganizing villages and residential groups, dissolving, naming, renaming villages and residential groups, and decide on arranging and reorganizing villages and residential groups; the dissolution, resolution, naming, and renaming of villages and residential groups in the area.
