The Ministry of Home Affairs has just completed a draft Decree of the Government regulating the organization of public service units to submit to the Ministry of Justice for appraisal.
The draft Decree regulating the organization of public service units is developed to ensure consistency with the new organizational structure of ministries, branches and localities after removing the general department model, rearranging internal units, and at the same time being consistent with the 2-level local government model.
Regarding the criteria and conditions for establishing public service units, the Ministry of Home Affairs proposes to comply with the planning approved by competent authorities according to the provisions of law on planning or the Project on planning the network of public service units by industry and field approved by competent authorities;
Meet all criteria and conditions according to the provisions of specialized laws; Clearly define the goals, functions and tasks of public service providers serving state management;
Notably, the Ministry of Home Affairs proposes to ensure a minimum number of employees of 15 (except for public service units providing basic and essential public service services established in accordance with the provisions of specialized laws).
For public service units that self-insure regular expenditures, public service units that self-insure regular expenditures and investment expenditures, when establishing these units, the minimum number of employees includes civil servants and professional and technical staff under the labor contract regime is determined according to the Establishment Project.
For public service units abroad, the number of employees shall be approved by the Prime Minister in the Project to establish public service units.
For public service units abroad, in addition to meeting the conditions specified in Points a, b, c, and d of this Clause, it is necessary to ensure compliance with the foreign policies of the Party and State and the agreement between the Government of the Socialist Republic of Vietnam and the Government of the host country on the establishment and operation of public service units.
The draft also proposes to abolish the regulation on public service units under general departments and branches within general departments to ensure compliance with the new organizational structure of ministries.
Replace the phrase "District People's Committee" into People's Committee of communes, wards, and special zones under provinces and centrally run cities (collectively referred to as commune level) to ensure compliance with the 2-level local government model.
In addition, the Draft adds the principle that newly established public service units must self-guarantee regular and investment expenditures, except in cases established under the provisions of specialized law (to ensure full coverage of newly established public service units with a level of autonomy in self-guaranteeing regular expenditures according to the provisions of specialized laws such as the Construction Investment Project Management Board, etc.).
