On April 25, continuing the 44th session, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Organization of the People's Procuracy.
Presenting the report, Director of the Supreme People's Procuracy Nguyen Huy Tien said that in order to institutionalize the Party's policies, the draft Law proposes to stipulate the organization of the People's Procuracy system, which will be reorganized from 4 levels to 3 levels.
Accordingly, from the Supreme People's Procuracy, high-level, provincial-level, district-level to the Supreme People's Procuracy, provincial-level, regional-level; Military Procuracy at all levels. Thus, there will be no organization of the High-level People's Procuracy and the District People's Procuracy.
The Draft Law also amended and supplemented in the direction of raising the number of Supreme People's Procurers of the Supreme People's Procuracy up to 19 people to 27 people to ensure human resources perform the prosecution tasks and inspect the trial with the activities of the Supreme People's Court Court Council (TAND).
Reviewing this content, Chairman of the Law and Justice Committee Hoang Thanh Tung stated his approval of the necessity of promulgating a revised law.
The Committee agreed with the draft Law and suggested that the Supreme People's Procuracy continue to review and propose amendments to relevant provisions in the current Law on Organization of the Supreme People's Procuracy.
This is to fully and correctly implement the Party's requirements for a 3-level People's Procuracy system, ending the activities of the High-level People's Procuracy and the District People's Procuracy.
According to Chairman of the Law and Justice Committee Hoang Thanh Tung, the draft Law stipulates that the number of prosecutors of the Supreme People's Procuracy shall not exceed 27 people (current law stipulates no more than 19 people).
However, the Committee proposed to consider carefully and thoroughly the proposal to increase the number from 19 to 27 to meet the increase in the central level due to the end of the operation of the Court and the High -Level People's Procuracy.
Because this is not in line with the Party's consistent policy on streamlining the apparatus, promoting decentralization and delegation of power, avoiding pushing judgments to higher levels, especially pushing judgments to the central level, along with other reasons.
Giving his opinion later, Chairman of the National Defense, Security and External Relations Committee Le Tan Toi said that when organizing the People's Procuracy of the region, the court must also be at the regional level and the investigation agency must also be at the regional level to reach an agreement.
At the same time, Mr. Le Tan Toi questioned who created this area to create national unity.
In addition to the region's authority, Director Nguyen Huy Tien said that in the acquisition and explanation, the People's Procuracy of the provincial and the region has decided to establish and dissolve by the National Assembly Standing Committee at the proposal of the Director of the Supreme People's Procuracy on the scope and authority by territory.
Regarding the increase in the number of Supreme People's Procurers, Mr. Nguyen Huy Tien explained due to the duties of the High -level People's Procuracy to transfer partially to the provincial People's Procuracy, partly to the Supreme People's Procuracy, so it must be added to ensure the task requirements.
