The amendment of regulations on the basis for the Chairman of the Commune-level People's Committee to decide to establish a Coordinating Council for dissemination and legal education aims to create a clear legal basis.

On the morning of August 3rd, the First Extraordinary Session of the 16th National Assembly officially opened.

In the opening session, Member of the Party Central Committee, Minister of Justice Hoang Thanh Tung, authorized by the Prime Minister, presented a report on 2 draft Laws, including: Law on Dissemination and Legal Education (amended); Law amending and supplementing a number of articles of the Law on State Compensation Liability.

Immediately after that, the Chairman of the National Assembly's Law and Justice Committee (UBPLTP) presented an appraisal report on the above 2 draft Laws.

Regarding the draft Law on Dissemination and Education of Law (amended), Member of the Party Central Committee, Chairman of the National Assembly's Law Committee Phan Chi Hieu said that the Law Committee agrees with the necessity and purpose of building the Law; basically agrees with the scope of amendments and supplements of the draft law.

According to Mr. Phan Chi Hieu, the content of the draft law is basically consistent with the Party's guidelines and policies; ensuring constitutionality, consistency with the legal system, compatibility with relevant international treaties and has regulations promoting the application of science, technology, innovation and digital transformation.

In addition, the UBPLTP also mentioned some opinions to request the Government to direct the continued review of the above draft Law.

In the current draft Law, the establishment of the Coordinating Council for Dissemination and Legal Education (PBGDPL) is stipulated "Can be established at the commune level by the Chairman of the Commune People's Committee deciding according to the guidance of the Provincial People's Committee".

Many opinions in the UBPLTP proposed to stipulate that the Chairman of the Commune-level People's Committee can decide to establish a Council according to "regulations of the Provincial-level People's Committee" instead of according to "instructions of the Provincial-level People's Committee".

According to the UBPLTP, the above change aims to create a clear and transparent legal basis in the establishment of the PBGDPL Coordination Council at the commune level, ensuring compliance with the provisions of the Law on Promulgation of Legal Documents (VBQPPL).

Some opinions also suggested "hardening" the establishment of this Council at the commune level because this is the level of government closest to the people and the commune level after arrangement is large-scale.

Regarding the regulation on special subjects (Article 16), the majority of opinions in the UBPLTP agreed with the regulation on special subjects as in the draft Law. In addition, some opinions suggested further clarifying the criteria and principles for determining what are "difficulties and limitations in accessing the law" to serve as a basis for assigning the Government to detail this group of special subjects, ensuring transparency and unity in implementation organization.

In addition, the Law only stipulates the criteria and principles for determining special subjects and assigns the Government to specifically identify special subjects to ensure timeliness and suitability with actual requirements.

Article 16. Specific subjects

1. Ethnic minorities; people residing in areas with particularly difficult socio-economic conditions.

2. Workers in industrial parks and export processing zones; workers with salaries equal to the regional minimum wage according to the provisions of law.

3. Victims of violence, people with violent acts in cases of domestic violence, school violence or other violence; victims of human trafficking.

4. People with disabilities.

5. People from poor households, people from near-poor households.

6. The elderly.

7. People serving imprisonment, people sentenced to imprisonment with suspended sentences, people sentenced to non-custodial reform, people who have completed imprisonment and are reintegrating into the community; people who are being subject to administrative sanctions.

8. Other subjects with difficulties and limitations in accessing the law as prescribed by the Government.

In addition, the UBPLTP proposed to study and more clearly stipulate the principles and requirements for policy communication activities to avoid the impact of public opinion on the review and decision process of the policy approval agency or the agency issuing VBQPPL, and at the same time more clearly stipulate policy communication, ensuring no duplication with the collection of opinions on projects and draft documents in the process of law-making, avoiding duplication and waste of resources.

It is expected that if passed, this Law will take effect from March 1, 2027.
