The Ministry of Home Affairs is seeking opinions on the draft Law amending and supplementing a number of articles of the Labor Code, the Law on Archives, the Law on Gender Equality and the Law on Red Cross Activities.
Accordingly, regarding the Labor Code, the Ministry of Home Affairs proposes to amend and supplement Clause 3, Article 112 on holidays and Tet.
The draft law adds point g after point e, clause 1 of the above article as follows: "Vietnamese Culture Day: 1 day (November 24th of the solar calendar)".
The draft also states that every year, based on actual conditions, the Prime Minister decides the specific regulated holiday. The Minister of Home Affairs shall notify the specific holiday and Tet holidays decided by the Prime Minister before December 31 of the immediately preceding year.
The draft has delegated the task of specifically announcing holidays and Tet holidays annually by the Minister of Home Affairs to apply to cadres, civil servants, public employees and employees working in administrative agencies, public service units, political organizations, and socio-political organizations.
According to the draft submission of the Ministry of Home Affairs, Resolution No. 80-NQ/TW of the Politburo on the development of Vietnamese culture has "unifiedly chosen November 24th every year as "Vietnamese Culture Day".
With the policy of holidays, workers are entitled to full salary, so that people can improve their ability to enjoy culture, artists are encouraged to be creative, and the whole society promotes and practices a cultural and civilized lifestyle. Therefore, the Ministry of Home Affairs has proposed to supplement regulations related to holidays and Tet every year.
According to the provisions of the 2019 Labor Code, employees are entitled to leave work and receive full salary on holidays and Tet every year.
Article 112 clearly states the holidays including: New Year's Day (1 day), Lunar New Year (5 days), Victory Day April 30 (1 day), International Labor Day May 1 (1 day), National Day September 2 (2 days) and Hung Kings Commemoration Day (1 day, March 10 lunar calendar). Workers who are foreigners working in Vietnam, in addition to the above days, are also entitled to 1 more day of traditional Tet and 1 national day of their country.
After institutionalizing the policy of the Politburo, in 2026, people nationwide will have 1 more holiday day, increasing the number of holiday days to 12 days.
